CITY OF SAN LEANDRO
STAFF REPORT
DATE: July 20, 2009
TO: Stephen Hollister, City Manager
FROM: Michael Bakaldin, Public Works Director M~
BY: Jennifer Nassab, Administrative Analyst
SUBJECT PROJECT/PROJECT DESCRIPTION:
APPROVED AND
FORWARDED
TO CITY COUNCIL
Stephen L. Hollister
City Manager
RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER
AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND
ALAMEDA CO UNTY IND USTRIES, INC.
SUMMARY AND RECOMMENDATION
Staff recommends authorizing the City Manager to execute a letter amendment to the Franchise
Agreement for Solid Waste, Recyclables, and Green Waste Services ("Agreement") between the
City of San Leandro and Alameda County Industries, Inc. (ACI). The letter amendment would
modify the conditions of the Agreement as it is extended for an additional term.
BACKGROUND
The City of San Leandro entered into the Agreement with ACI on February 1, 2000 for a period
of ten (LO) years with an option to extend the term an additional ten (10) years. As part of the
extension process, the City has conducted a performance and financial review of ACI's billing
records and payments to the City. In addition, the City Council approved a ten percent (10%) rate
increase effective July 1, 2009, with the provision that the City and ACI will negotiate
amendments to the Agreement for the purposes of streamlining the rate review process and for
providing additional collection services to rate payers.
Analysis
On October 21, 2008, the City entered into a contract with R3 Consulting Group (R3) to conduct
a Review and Assessment of the Contract Services provided by ACI as required under Section
3.3 of the Agreement. The results of the review indicate that ACI is in material compliance with
the terms of the contract, has corrected areas of non-compliance identified in the 2005 Review
and Assessment, and has met all of the financial obligations to the City. In addition, R3 provided
the following recommendations to enhance ACI's operational and financial performance:
• Use a "true" 20-gallon residential cart to avoid problems of under-billing;
• Increase supervisor safety and quality service observations;
• Schedule routine painting and refurbishing of bins and debris boxes;
• Enhance safety reporting and analysis;
