S <br />.~ <br />r,, <br />i~ <br />LICENSE AGREEMENT <br />This license agreement is made at San Leandro, California as of June 24, 1995, between <br />the City of San Leandro, a municipal corporation ("City"), and GETTY SYNTHETIC FUELS, <br />INC. ("Licensee") <br />City and Licensee agree as follows: <br />1. PURPOSE: This license agreement is made for the convenience of the Licensee <br />and for the benefit of the City. The parties hereto expressly find and declare that it is to the <br />public's benefit for Gity to permit Licensee, by virtue of this agreement, to use the property of <br />City for the purposes enumerated herein. <br />2. GRANT OF LICENSE: City grants to Licensee a revocable license to enter upon <br />and use the property of the City described in Exhibit A, which is attached hereto and <br />incorporated herein by this reference. <br />3. USE OF LICENSED PROPERTY: Licensee shall have the nonexclusive right to <br />use the subject property for the sole purposes described in Exhibit B, which is attached hereto <br />and incorporated herein by this reference, and for no other purposes. Without written consent of <br />the City Manager, any change in use or alteration of design or layout of improvements from that <br />which may be described in Exhibit B shall, without limiting the terms of paragraph 5, be cause <br />for revocation of this license by City. <br />4. TERM: Them of this license shall be for 10 years commencing on the date of ~;` <br />this agreement, subject to the provisions of paragraphs 5 & 6. <br />5. REVOCATION: City reserves the right to revoke the license herein granted for <br />any breach of this license agreement or for any act or omission on the part of Licensee contrary <br />to the public interest in the sole, exclusive and absolute determination of the City.
