Recording Requested by <br />and when recorded return to: <br />City of San Leandro <br />835 East 14t" Street <br />San Leandro, CA 94577 <br />Attention: City Manager <br />EXEMPT FROM RECORDING FEES PER <br />GOVERNMENT CODE §§6103, 27383 <br />IMPROVEMENT AGREEMENT <br />use. <br />This Improvement Agreement (this "Agreement") is made and entered into <br />effective as of ~ ~ ~ ~ , 2010 ("Effective Date") by and between the City <br />of San Leandro, a municipal corporation ("City") and Chang Income Property <br />Partnership, L.P., San Leandro Land Series (R11), a Delaware limited partnership <br />("Owner"). City and Owner are referred to herein as the "Parties." <br />RECITALS <br />A. Owner is the owner of that certain real property situated in the City of San <br />Leandro, County of Alameda, State of California, which is described and depicted as Lot <br />1 and Lot 2 of Tract 8010 as shown on Exhibit A attached hereto and incorporated <br />herein by this reference (the "Property"). Lot 3 is also described and depicted on <br />Exhibit A, but this Agreement concerns only Lot 1 and Lot 2, and, as used in this <br />Agreement, the term "Property" does not include Lot 3. <br />B. Owner has presented to City for approval a certain Tract Map for the <br />Property (the "Map") pursuant to the California Subdivision Map Act (Government Code <br />Section 66410 et seq.) (the "Map Act") and the San Leandro Municipal Code. <br />C. Owner has requested approval of the Map prior to the construction and <br />completion of the public and private improvements that are required by the Map Act, <br />City's Subdivision Regulations, and the conditions of approval pursuant to Vesting <br />Tentative Map #8010 dated December 22, 2008 (the "Conditions of Approval") as set <br />forth in City Council Resolution No. 2009-027 (the "Resolution") adopted on March 2, <br />2009. <br />D. Owner intends to provide, install and construct: (A) those certain <br />improvements (hereafter the "Private Improvements") which are designated as <br />"Private Improvements" on (i) those certain plans and specifications entitled "Off-Site <br />Improvements Tract 8010" dated January 12, 2010, approved by the City, and on file in <br />the office of the City Engineer, and (ii) those certain plans and specifications entitled <br />1328680-7 <br />
