Hollister <br />City Manager <br />IN ACCORDANCE WITH THE REQUIREMENTS OF PROPOSITION 2.18, A RESOLUTION <br />AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO MAIL NOTICE OF <br />PROPOSED SEWER AND WASTEWATER TREATMENT RATE INCREASES; TO SET A <br />45 DAY PROTEST PERIOD; AND TO SET A DATE TO HOLD A PUBLIC HEARING TO <br />RECEIVE PROTESTS TO PROPOSED RATE INCREASES TO FUND CONTINUED <br />MAINTENANCE AND OPERATIONS, AS WELL AS SEISMIC REPAIRS AND <br />COMPREHENSNE MODERNIZATION OF THE WATER POLLUTION CONTROL PLANT <br />(WPCP) <br />SUMMARY AND RECOMMENDATION <br />In accordance with the requirements of Proposition 218, staff recommends that the City Council <br />approve a resolution that: <br />• Authorizes staff to mail to all property owners served by the City's Water Pollution <br />Control Plant (WPCP) notice of proposed sewer and wastewater treatment rate increases <br />and a public hearing to receive and count protests to such rate increases; <br />• Sets May 5, 2010 to June 21, 2010 as the protest period; and <br />• Sets June 21, 2010, 7 p.m. (or as soon thereafter) at San Leandro City Hall as the date, <br />time and place for a public hearing to receive and count the protests to the proposed rate <br />increases. <br />BACKGROUND <br />The City is considering raising rates for sewer/wastewater treatment services to fund continued <br />maintenance and operations, as well as seismic repairs and comprehensive modernization of the <br />wastewater treatment facility. Before the City may raise those rates, it must comply with the <br />procedural requirements of Prop. 218, which provides that the City must do the following: <br />1. Identify the parcels upon which the increased rates will apply. <br />2. Calculate the amount of the rate increase proposed to be imposed upon each parcel. <br />
