IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 2000- 08 (1153/1184/ag0) <br /> AN ORDINANCE AMENDING CHAPTER 1 OF TITLE VII OF <br /> THE CITY OF SAN LEANDRO MUNICIPAL CODE RELATING TO <br /> MAPS, BUILDINGS AND SUBDIVISIONS, AND REVISING PARK LAND <br /> DEDICATION REQUIREMENTS TO MORE ACCURATELY REFLECT EXISTING <br /> STANDARDS FOR DEVELOPED PARK LAND <br /> RECITALS <br /> WI- IEREAS, Government Code Section 66477, also known as the "Quimby Act ", <br /> establishes statutory guidelines allowing local governments to require the dedication of land <br /> and/or payment of fees in lieu thereof for park or recreational purposes as a condition to the <br /> approval of a tentative map or parcel map; and <br /> WHEREAS, Government Code Section 66477 (a) (2) provides, "The amount of land <br /> dedicated or fees paid shall be based upon residential density;" and <br /> WI- IEREAS, Sections 805 et. seq. of Chapter 1 of Title VII of the City of San <br /> Leandro Municipal Codc requires subdividers of land within the City to dedicate land and/or <br /> pay fees in lieu of dedication for neighborhood and community park or recreational purposes <br /> as a condition of approval of final or parcel maps; and <br /> WI-IEREAS, Section 815 states that "the City devotes approximately 3.0 acres of <br /> property for each 1,000 persons residing within the City, to neighborhood and community <br /> park and recreational purposes;" and <br /> WHEREAS, Section 820 sets standards and a formula for dedication of land pursuant <br /> to this standard; and <br />
