• <br /> ® <br /> • <br /> tike O <br /> 99 -oas <br /> c'7-19 -99 <br /> MEMORANDUM OF UNDERSTANDING REGARDING TI IE (I V Of I3 f 3-0 <br /> WEST SAN LEANDRO- MACARTHUR BOULEVARD REDEVELOPMENT PLAN <br /> This is an Agreement dated for the convenience of the Parties hereto as of November 30, <br /> 1999, and is entered into between the City of San Leandro, a municipal corporation ("the City") <br /> and the County of Alameda, a political subdivision of the State of California ("the County "). <br /> RECITALS <br /> A. The City of San Leandro adopted the West San Leandro - MacArthur Boulevard <br /> Redevelopment Plan (the "Redevelopment Plan ") on July 19, 1999. <br /> B. The County supports the Redevelopment Plan, but contends that some portions of <br /> the West San Leandro - MacArthur Boulevard Project Area ( "Project Area ") are not blighted <br /> enough, under the legal definition of blight as set forth in the Community Redevelopment Law, <br /> to require the use of tax increment funds to redevelop those portions of the Project Area. <br /> C. The City has found that these portions do indeed meet the definition of blight, but <br /> in the interests of maintaining a positive relationship with the County, has agreed to modify the <br /> Redevelopment Plan to address the concerns of the County. <br /> D. The County is considering locating a new Alameda County Medical Examiner's <br /> office within the Project Area and the City supports the County in that endeavor. <br /> NOW, THEREFORE, it is agreed as follows: <br /> 1. Plan Amendment. The City of San Leandro and the Redevelopment Agency of the <br /> City of San Leandro ( "Agency ") shall process an amendment to the Redevelopment Plan that <br /> will eliminate the collection of tax increment funds from the properties identified in the <br /> Assessor's Parcel Numbers in Exhibit A and described as Areas A, B and C. The properties will <br /> remain within the Project Area. To facilitate the administration of the project's tax increment <br /> financing by the County Assessor and County Auditor- Controller, the City and Agency shall <br /> apply to and work with the State Board of Equalization to establish Areas A, B and C as discrete <br /> tax rate areas. <br /> 2. Timing of Plan Amendment. The Plan amendment will be completely processed no <br /> later than August 20, 2000. <br /> 3. County Facilities. If the County decides to pursue the purchase of the property <br /> currently on the market located at Fairway and Merced in San Leandro for a medical examiner's <br /> office building, the City agrees to support the acquisition of the property and construction of the <br /> project. Neither the City nor the Agency shall provide monetary resources to the project, but the <br /> 1 . <br />
