., • <br /> • <br /> IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 97 -018 (1413/2624) <br /> AN ORDINANCE MAKING FINDINGS AND ADDING ARTICLE 2, <br /> CHAPTER 16, TITLE III TO THE SAN LEANDRO MUNICIPAL CODE <br /> RELATING TO COST RECOVERY FOR GRAFFITI ABATEMENT <br /> The City Council of the City of San Leandro does ORDAIN as follows: <br /> • <br /> • <br /> SECTION 1: RECITALS <br /> A. Defacement of property by minors imposes an ongoing financial burden <br /> on the City for the costs associated with identifying and apprehending the responsible <br /> • minor and cleanup or replacement of the affected property. <br /> B. Welfare and Institutions Code Section 742.14 provides a method for <br /> recouping these costs from the responsible minors. <br /> SECTION 2: Pursuant to Welfare and Institutions Code Sections <br /> 742.14(b) and 742.14(c), the City Council of the City of San Leandro hereby finds <br /> that: <br /> • <br /> (a) the average cost associated with identifying and apprehending <br /> minors who have defaced property is 5250. <br /> (b) the average cost associated with abating graffiti on City-owned <br /> property is S20 per square foot. <br /> SECTION 3: Article 2 of Chapter 16 is hereby added to Title III of the <br /> San Leandro Municipal Code to read as follows: - <br /> "ARTICLE 2 Cost Recovery for Graffiti Abatement. <br /> 3 -16 -200 Authorization for recouoment. The City Council of the <br /> City of San Leandro hereby authorizes the probation officer for the County of <br /> Alameda, pursuant to Welfare and Institutions Code Section 742.14(a), to recoup <br /> 1 <br /> • <br />
