The Agency and Creekside Associates, LLC heretofore entered into <br /> that certain Amended and Restated Disposition and Development Agreement, <br /> (the "DDA ") dated July 17, 2000, a copy of which is recorded with the County of <br /> Alameda, (Instrument Series No. 2001 - 161041) and is on file with the Agency <br /> Secretary. <br /> 2. Subsequent to the execution of the DDA, The Agency executed a <br /> Consent Agreement dated April 25, 2001 consenting to the establishment of <br /> undivided fifty percent (50 %) interests in the ownership of the property with <br /> Creekside Associates LLC owned entirely by David C. Irmer, and T. Lawrence <br /> Jett, a married ,man as his sole and separate property, (hereinafter the <br /> "Developer "). <br /> 3. Section 4.10 of said DDA provides that upon completion of the <br /> Developer Improvements, the Agency will issue a Certificate of Completion <br /> certifying that the construction of the Developer Improvements has been <br /> completed. Such Certificate of Completion shall be in such form as to enable it <br /> to be recorded'in the official records of Alameda County. <br /> 4. The Developer has notified the Agency and the Agency hereby <br /> acknowledges that the Developer has completed the following components of the <br /> Developer Improvements: (a) a portion of the Minimum Office Improvements <br /> consisting of one approximately 100,000 square foot office building (commonly <br /> referred to as Building "A ") on Parcel B of Parcel Map 7758.(which constitutes <br /> satisfactory completion of all Developer Improvements on Parcel B), and a <br /> parking garage and landscaping improvements on Parcel D of Parcel Map 7758; <br /> (b) all of the Adjacent City Property Improvements; and (c) all of the <br /> Condominium Benefiting Improvements. <br /> • <br /> • <br />
