IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2011 -008 <br /> RESOLUTION AUTHORIZING THE CITY MANAGER TO DEDICATE NET REVENUE <br /> FROM THE WATER POLLUTION CONTROL PLANT ENTERPRISE FUND TO REPAY <br /> THE STATE REVOLVING FUNDING PROGRAM FINANCING FOR THE <br /> CONSTRUCTION OF THE WATER POLLUTION CONTROL PLANT (WPCP) <br /> REHABILITATION PROJECT; <br /> PROJECT NO. 08- 593 -52 -239, CWSRF NO. C06- 7002 -110 <br /> Recitals <br /> WHEREAS, on June 21, 2010, the City of San Leandro complied with all Proposition <br /> 218 procedures, and in so doing the City did not receive a majority protest against the proposed <br /> sewer and wastewater rate increases. Subsequently, the City Council approved an increase in <br /> wastewater and sewer rates in part to fund the costs of the Water Pollution Control Plant <br /> Rehabilitation Project, No. 08- 593 -52 -239 (the "Project "); and <br /> WHEREAS, in order to satisfy all debt and funding obligations related to the Project, the <br /> City is required to dedicate Water Pollution Control Plant Enterprise Fund net revenues toward <br /> the payment of any and all State Clean Water Revolving Fund loans and other obligations <br /> incurred by the City to be used for the construction of the Project; and <br /> WHEREAS, the City Council will commit such funds and authorize the City Manager to <br /> take all actions and execute all documents necessary to dedicate Water Pollution Control Plant <br /> Enterprise Fund net revenues towards the payment of and throughout the term of such financing <br /> unless modification or change of such dedication is approved in writing by the State Water <br /> Resources Control Board, <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> That all recitals above are true, correct and incorporated herein; and <br /> That the City Council approves the dedication of Water Pollution Control Plant <br /> Enterprise Fund net revenues towards the payment of any and all Clean Water State Revolving <br /> Fund and/or Water Recycling Funding Program financing, and that the dedicated source of net <br /> revenues shall remain in effect throughout the term of such financing unless modifications or <br /> changes of such dedication are approved in writing by the State Water Resources Control Board; <br /> and <br /> That the City Council authorizes the City Manager to execute all documents and take all <br /> actions necessary to make all approved actions effective. <br />
