Hollister, City Manager <br /> FROM: Luke Sims, Community Developme t Directolfi <br /> BY: Sally Barros, Senior Planner --rr <br /> SUBJECT PROJECT /PROJECT DESCRIPTION: <br /> MATTER OF CONSIDERATION OF AMENDMENTS TO THE CITY OF SAN LEANDRO <br /> ZONING CODE RELATED TO DOWNTOWN AREA (DA) USES, PARKING AND <br /> DEFINITIONS AND TO ARTICLES 3 AND 7 RELATED TO CONFORMANCE TO THE <br /> SB2 FAIR SHARE ZONING LAW <br /> SUMMARY AND RECOMMENDATION <br /> The Community Development Department, Planning Division, is undertaking the first of several <br /> "clean up" updates of the Zoning Code. The first of these updates is intended to keep current <br /> with the State - mandated SB2 Fair Share Zoning Law, related to homeless shelters, and to address <br /> needed adjustments to the 2007 adoption of the Downtown Area (DA) use and parking <br /> regulations. <br /> Staff recommends that the City Council hold a public hearing to adopt the Negative <br /> Declaration/Initial Study and the proposed Zoning Code amendments related to the Downtown <br /> uses, parking and definitions and to conformance with SB2 Fair Share Zoning. <br /> BACKGROUND <br /> SB2 Fair Share Zoning Law <br /> SB2 requires that every city and county assess how many homeless persons are in their <br /> community and to identify zones, in the Housing Element of their General Plan and in their <br /> Zoning Codes, where emergency homeless shelters are allowed to locate without a conditional <br /> use permit or other discretionary permit. Cities are required to comply with the zoning <br /> requirement at their next regular update cycle. Cities that cannot comply at the next update cycle <br /> must do so no later than a year after adoption of their Housing Element. The City of San <br /> Leandro's Housing Element adoption occurred in July 2010. <br />
