P.E. irector <br /> Engineering and Transpo tion Department <br /> 13Y: Kenneth Joseph, P.E., City ngineer <br /> Engineering and Transportation Department <br /> SUBJECT /PROJECT DESCRIPTION: <br /> RESOLUTION APPROVING A REPAIR AND MAINTENANCE AGREEMENT WITH THE <br /> PORT OF OAKLAND RELATED TO THE BAY TRAIL SLOUGH BRIDGE PROJECT, <br /> PROJECT NO. 08- 144 -39 -012, FEDERAL AID PROJECT NO. HP2IL- 5041(025), <br /> CONSTRUCTED ON PORT PROPERTY. <br /> SUMMARY AND RECOMMENDATION <br /> Staff recommends approval of a Repair and Maintenance Agreement with the Port of Oakland <br /> for the subject facility. <br /> BACKGROUND <br /> The completed Bay Trail Slough Bridge project is located on three parcels. Each parcel is under <br /> separate ownership: the Port of Oakland (Port), East Bay Regional Park District (EBRPD) and <br /> the City of San Leandro (City). By previous agreement with the Port, the Port took ownership <br /> and general maintenance responsibility of the improvements located on its property and will take <br /> full maintenance responsibilities upon expiration of the contractor's 12 -month warranty period. <br /> The Repair and Maintenance Agreement identifies the limits of the Port's and the City's <br /> responsibilities and provides access rights to each for repair and maintenance operations. <br /> Analysis <br /> Construction was completed on May 25, 2010. The Port took ownership of the improvements on <br /> Port property on May 26, 2010 and will assume full maintenance responsibilities on May 26, <br /> 2011. This agreement formally apportions the maintenance and repair responsibilities for the <br /> sections of the subject project that reside in each jurisdiction. The agreement states the level of <br /> maintenance expected and the remedies for breach of the agreement. <br />
