P.E. irector Engineering and Transpo tion Department 13Y: Kenneth Joseph, P.E., City ngineer Engineering and Transportation Department SUBJECT /PROJECT DESCRIPTION: RESOLUTION APPROVING A REPAIR AND MAINTENANCE AGREEMENT WITH THE PORT OF OAKLAND RELATED TO THE BAY TRAIL SLOUGH BRIDGE PROJECT, PROJECT NO. 08- 144 -39 -012, FEDERAL AID PROJECT NO. HP2IL- 5041(025), CONSTRUCTED ON PORT PROPERTY. SUMMARY AND RECOMMENDATION Staff recommends approval of a Repair and Maintenance Agreement with the Port of Oakland for the subject facility. BACKGROUND The completed Bay Trail Slough Bridge project is located on three parcels. Each parcel is under separate ownership: the Port of Oakland (Port), East Bay Regional Park District (EBRPD) and the City of San Leandro (City). By previous agreement with the Port, the Port took ownership and general maintenance responsibility of the improvements located on its property and will take full maintenance responsibilities upon expiration of the contractor's 12 -month warranty period. The Repair and Maintenance Agreement identifies the limits of the Port's and the City's responsibilities and provides access rights to each for repair and maintenance operations. Analysis Construction was completed on May 25, 2010. The Port took ownership of the improvements on Port property on May 26, 2010 and will assume full maintenance responsibilities on May 26, 2011. This agreement formally apportions the maintenance and repair responsibilities for the sections of the subject project that reside in each jurisdiction. The agreement states the level of maintenance expected and the remedies for breach of the agreement.
