IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 2014-013 <br /> ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESCINDING IN ITS ENTIRETY SAN LEANDRO MUNICIPAL CODE <br /> CHAPTER 2-19 UPON THE APPROVAL BY A MAJORITY VOTE OF THE ELIGIBLE <br /> VOTERS WITHIN THE CITY OF SAN LEANDRO OF THE BALLOT MEASURE <br /> (MEASURE ) ON THE NOVEMBER 4,2014 BALLOT ESTABLISHING A <br /> TEMPORARY TRANSACTIONS AND USE TAX WITHIN THE <br /> CITY OF SAN LEANDRO <br /> RECITALS <br /> WHEREAS, it is the intent of the City Council of the City of San Leandro to place before <br /> the eligible voters of the City a measure (Measure )to extend at the one half of one percent <br /> rate (0.5%) a temporary transactions and use tax upon the City's November 4, 2014 election <br /> ballot; and <br /> WHEREAS, if the measure passes by a majority vote of the eligible voters of the City, <br /> then Measure , as a measure of the people of the City of San Leandro, shall immediately go <br /> into effect; and <br /> WHEREAS,pursuant to the enactment of Measure by ordinance, Chapter 2-19 of <br /> the San Leandro Municipal Code, and all of its provisions should, by the action taken hereto,be <br /> rescinded in its entirety; and <br /> WHEREAS, if Measure on the November 4, 2014 ballot is not passed by a majority <br /> vote of the eligible voters of the City,then it is the City Council's stated intent that the existing <br /> ordinance shall remain in full force and effect. <br /> NOW THEREFORE,the City Council of the City of San Leandro does ordain as follows: <br /> Section 1. The Recitals above are true and correct, and made a part hereof. <br /> Section 2. San Leandro Municipal Code Chapter 2-19 shall be rescinded in its entirety, <br /> and shall have no further force and effect if and only upon the passage of Measure on the <br /> City of San Leandro November 4, 2014 ballot. <br /> If Measure does not pass, then this Ordinance shall not become effective, and shall <br /> have no force or effect. <br /> Section 3. Effective Date. The effective date of this Ordinance shall be the same as the <br /> effective date of the Ordinance that enacts Measure on the City of San Leandro November <br /> 4, 2014 ballot. <br />
