4 <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 96- 61 (1120) <br />RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN LEANDRO APPROVING A MITIGATED NEGATIVE DECLARATION <br />FOR THE FORM OF A DISPOSITION AND DEVELOPMENT AGREEMENT FOR <br />PROPERTIES AT 1066, 1072, AND 1152 MARINA BOULEVARD, <br />COUNTY OF ALAMEDA - CITY OF SAN LEANDRO <br />JOINT REDEVELOPMENT PROJECT <br />WHEREAS, the Redevelopment Agency of the City of San Leandro ("Agency") and <br />the Batarse Family Trust agreed to negotiate a Disposition and Development Agreement <br />("DDA") for the development of automobile dealerships utilizing properties at 1066, 1072, and <br />1152 Marina Boulevard, City of San Leandro; and <br />WHEREAS, the Agency will consider a Resolution of Intent to Condemn real property <br />parcels in the City of San Leandro/Alameda County Joint Redevelopment Project Area <br />("Proposed Condemnation"); and <br />WHEREAS, an Initial Study and Mitigated Negative Declaration were prepared in early <br />1996 and circulated for public review from March 4, to March 25, 1996. The City Council <br />has received copies of the Initial Study and the Mitigated Negative Declaration; and <br />WHEREAS, no written comments were received during the public comment period <br />which concluded on March 25, 1996. <br />NOW, THEREFORE, the City Council of the City of San Leandro does resolve as <br />follows: <br />1. That, pursuant to the California Environmental Quality Act, the City Council makes the <br />following findings: <br />I. That the City Council finds that the City Council and Agency, acting as lead <br />agencies for the DDA and Proposed Condemnation have conducted an <br />independent analysis of the adequacy of the proposed Mitigated Negative <br />Declaration. <br />II. That the City Council finds that, on the basis of the following specific findings, <br />that the DDA and Proposed Condemnation will not have a significant effect on <br />the environment: <br />
