4 IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 96- 61 (1120) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO APPROVING A MITIGATED NEGATIVE DECLARATION FOR THE FORM OF A DISPOSITION AND DEVELOPMENT AGREEMENT FOR PROPERTIES AT 1066, 1072, AND 1152 MARINA BOULEVARD, COUNTY OF ALAMEDA - CITY OF SAN LEANDRO JOINT REDEVELOPMENT PROJECT WHEREAS, the Redevelopment Agency of the City of San Leandro ("Agency") and the Batarse Family Trust agreed to negotiate a Disposition and Development Agreement ("DDA") for the development of automobile dealerships utilizing properties at 1066, 1072, and 1152 Marina Boulevard, City of San Leandro; and WHEREAS, the Agency will consider a Resolution of Intent to Condemn real property parcels in the City of San Leandro/Alameda County Joint Redevelopment Project Area ("Proposed Condemnation"); and WHEREAS, an Initial Study and Mitigated Negative Declaration were prepared in early 1996 and circulated for public review from March 4, to March 25, 1996. The City Council has received copies of the Initial Study and the Mitigated Negative Declaration; and WHEREAS, no written comments were received during the public comment period which concluded on March 25, 1996. NOW, THEREFORE, the City Council of the City of San Leandro does resolve as follows: 1. That, pursuant to the California Environmental Quality Act, the City Council makes the following findings: I. That the City Council finds that the City Council and Agency, acting as lead agencies for the DDA and Proposed Condemnation have conducted an independent analysis of the adequacy of the proposed Mitigated Negative Declaration. II. That the City Council finds that, on the basis of the following specific findings, that the DDA and Proposed Condemnation will not have a significant effect on the environment:
