<br />MINUTES Page 6 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-March 7, 2005 <br /> <br />She asked if a technical report was available at the stakeholders meeting held in March <br />2004. Mr. Wilson confirmed that a draft of the technical report, which was about 90% <br />complete, was available at that meeting. EBMUD received a copy of the draft report at <br />that time, but only received the final technical report around March 1 of this year. <br /> <br />Councilmember Nardine inquired about the expansion of recycled water service by <br />EBMUD which was mentioned by Mr. Williams. Mr. Wilson indicated that he has not <br />been made aware of any plans for expansion by EBMUD. <br /> <br />Councilmember Nardine stated that she agrees with the comments made by Mr. <br />Gilcrest, as she has received the reports that City staff has been providing to EBDA <br />regarding the project. <br /> <br />Mr. Jermanis noted that Mr. Williams raised the question of who has the right to <br />determine whether reclaimed water can be distributed. Mr. Jermanis stated that the City <br />is not trying to compete with EBMUD as a purveyor of water for sale. Instead, as Mr. <br />Gilcrest commented, the City wants to keep the water from being discharged into the <br />Bay. Mr. Jermanis indicated that staff is willing to continue to work with EBMUD to <br />keep it apprised of the progress on the project. Mr. Jermanis stated that the City would <br />like to provide EBMUD with the water it needs to serve its customers, while putting the <br />excess to good use for its own properties. <br /> <br />Councilmember Nardine commented that if EBMUD is considering an expansion of its <br />recycled water use, the City should be made aware of the plans. <br /> <br />Councilmember Glaze recalled that the Marina Ad Hoc Committee reviewed this item <br />about a year and a half ago. At that time, it was explained to the Committee that Phases <br />IA and IB involved distribution of water on City property, and therefore the City was <br />not a purveyor of water. He asked if the City Attorney had looked into the question <br />raised by EBMUD. <br /> <br />City Attorney Jayne Williams confirmed that she had looked into the issue and <br />researched the applicable statutes in the Public Resources Code and the Water Code. <br />She indicated that the City has the authority to provide recycled water to its own <br />facilities, and these facilities have not received recycled water from EBMUD in the past. <br />Ms. Williams stated that additionally, EBMUD's approval is not required, and the City <br />has been consulting with EBMUD on this matter for over a year. <br /> <br />Vice Mayor Badger asked if the City facilities included Oyster Bay. Ms. Williams <br />confirmed that the facilities include both Oyster Bay and the Monarch Bay Golf Course. <br /> <br />Referring to Section VII of the Environmental Checklist portion of the Draft Initial <br />StudylMND, Councilmember Santos asked if there was a chance for the accidental <br />release of hazardous materials into the environment. Mr. Bakaldin indicated that this <br />was a response to a generic question in the CEQA process. He noted that the project <br />will be a typical construction project, and he assumed the response likely has to do with <br />
