She asked if any of the public containers are located <br />in front of public schools. Mr. Jermanis indicated that he would ask Public Works staff <br />to determine the proximity of the public containers to public schools. <br /> <br />M/S/C Starosciak and Nardine. Resolution No. 2005-045, Resolution Approving Final Subdivision Map, Subdivision <br />Improvement Agreement, Stormwater Treatment Measures Maintenance Agreement, <br />Hold Harmless, Indemnification, and Maintenance Release for Alameda County, and <br />Acceptance of Dedication of Public Utility and Storm Drain Easements for Tract 7452 <br />on a Vacant Parcel Located at 1057 MacArthur Boulevard; Developer: Hennigan <br />Construction, Inc. [provides for development of nine (9) residential lots and one (1) <br />retail lot on an approximate 0.9 acre site on MacArthur Boulevard]. (3005) <br /> <br />Public Comments on Item 8.D.: <br /> <br />Lou Filipovich, San Leandro resident, addressed the City Council regarding <br />stormwater, City Council and School District boundaries and District 4 representation of <br />Heron Bay and Washington Manor. <br /> <br />End of Public Comments <br /> <br />Councilmember Starosciak asked why there is a need to add the stormwater treatment <br />unit and whether it is unique to this project. Mr. Jermanis responded that over the last <br />five or so years, the San Francisco Regional Water Quality Control Board has become <br />more involved in water run-off and its treatment. The City is operating under a permit <br />granted to Alameda County and works with the County to ensure that run-off water is <br />adequately treated. Recent housing developments have all required a means of filtering <br />run-off water. A treatment system is required to be installed for this project, and the <br />plan is to install a filtering system which will trap particulates from run-off before it <br />reaches San Leandro Creek. Mr. Jermanis noted that while the filtering system is <br />required by law, replacing the filters will place an additional burden on the City's Public <br />Works Department for which there is no funding source. He indicated that any proj ect <br />comprising one acre or more currently requires this type of filtering system, and the <br />requirement may be imposed on parcels of as little as 10,000 square feet in the future. <br />Mr. J ermanis commented that these requirements are creating a significant impact on <br />cities. <br /> <br />M/S/C Stephens and Santos.
