<br />MINUTES <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-June 6, 2005 <br /> <br />Page 16 <br /> <br />not the first time the City Council has been required to deal with other governmental agencies <br />which have their own powers. He gave the example of the Port of Oakland's airport <br />expansion, and the lawsuit filed by the City over the EIR for that project. <br /> <br />Mr. Jermanis stated that the City will do its best to monitor the project and respond <br />appropriately to the comments from EBMUD. Mr. Jermanis noted that this issue will not be <br />resolved immediately, and it will take patience and perseverance on the part of the community <br />to achieve a positive result. He assured the audience that the City will do its best to represent <br />the community as it did in its comments on the Draft EIR. <br /> <br />Regarding the Heron Bay Homeowners Association's comments on the Draft EIR, Mr. <br />J ermanis noted that there were accusations made against EBMUD that it did not disclose all <br />the information about the project. However, there is no hard evidence that it did anything <br />illegal or unethicaL Mr. J ermanis suggested that if the audience members who attended <br />tonight's meeting would also attend the EBMUD Board of Directors meeting and raise their <br />concerns directly to the Board members, it would have an impact. He also suggested <br />speaking directly with the two EBMUD Board members who represent the San Leandro area <br />would also have an impact. Mr. Jermanis indicated that this project would not go forward <br />without additional review and scrutiny by the City CounciL <br /> <br />City Attorney Jayne Williams reiterated the comments made by City Manager Jermanis. She <br />stated that the City Attorney's Office has been working with the City Manager and City staff <br />through this process. Ms. Williams noted that the environmental review process is a legal <br />procedure, and the procedure needs to run its course. She indicated that, should the Council <br />be dissatisfied with the results of the process, it can direct City staff to weigh in on the next <br />steps. Ms. Williams noted that staff is monitoring the process to ensure compliance and <br />adherence to legal procedures. <br /> <br />The City Council recessed from 10:30 to 10:40 p.m. <br /> <br />7. AMENDMENT OF CONSENT CALENDAR <br /> <br />City Councilmembers or staff have an opportunity at this time to request that an item be <br />removed from the Consent Calendar for the presentation of a staff report or other special <br />consideration. Members of the Public may request the opportunity to address the City <br />Council regarding items remaining on the Consent Calendar by filling out a speaker card and <br />submitting it to the City Clerk prior to the calling of Item 7, Amendment of Consent <br />Calendar. Items remaining on the Consent Calendar will be considered for approval under <br />one motion. <br /> <br />Councilmember Grant requested a correction to page 13 of Item 8.A., the City Council <br />Meeting Minutes of May 16, 2005. The first sentence of the last paragraph should read, <br />"Councilmember Grant commented that she is currently a member of the League's <br />Environmental Quality Policy Committee." The minutes will be revised to reflect this <br />correction. <br />
