<br />MINUTES <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-June 6, 2005 <br /> <br />Page 20 <br /> <br />Councilmember Grant asked if the property owners are required to disclose issues with <br />the building as with residential property. Mr. J ermanis confirmed that property owners <br />would be subject to disclosure requirements, and all the code compliance issues would <br />be addressed before the units are sold. He noted that the project was referred back to the <br />Planning Commission and Business Development Committee. The Planning <br />Commission felt that the project should be approved and viewed this project as a model <br />for future commercial condominium developments. Both the Planning Commission <br />and the Business Development Committee expressed the need to establish guidelines. <br />Mr. Jermanis indicated that those guidelines would likely be patterned after this project <br />with respect to issues such as bringing the building up to code and adequate notification <br />to tenants. Both the Planning Commission and Business Development Committee felt <br />that this project has all the merits of a model commercial conversion. The Business <br />Development Committee will develop the guidelines, which should come before the <br />Council in the next few months. <br /> <br />Councilmember Grant noted that residential condominiums have certain specifications <br />such as solid walls and how much plumbing is shared between units. She noted that in <br />his email message, Dr. McGlynn indicated that there is a single plumbing system for the <br />building. Councilmember Grant asked the developer if the system will be changed <br />when the building is converted to condos. Applicant Gay Quinn stated that, after the <br />May 2, 2005 City Council meeting, she reviewed both the Residential Condominium <br />Conversion Ordinance and the Subdivision Map Act. Ms. Quinn stated that she <br />believes the project meets the spirit of the Ordinance. She further stated that the <br />Subdivision Map Act has provisions that are distinctly different for commercial <br />condominiums. For this type of use, there is no requirement for separate plumbing or <br />full height partition walls. Ms. Quinn indicated that the plans have been through a <br />rigorous review by the Building Division, and the permit is ready to be issued. The <br />Residential Condominium Conversion Ordinance requires 6 months' notice to tenants. <br />Ms. Quinn noted that they have provided 8 months' notice. She stated that she hopes to <br />convert the building into a Class-A office building that would attract medical <br />professionals to San Leandro. She indicated that there has been a lot of outside interest <br />expressed in the building because the units will be purchased rather than leased. <br /> <br />Mayor Young asked about the tenants with long-term leases. Ms. Quinn stated that <br />those tenants have been informed that their leases will be honored. <br /> <br />Resolution No. 2005-075, Resolution Approving Parcel Map 8642 for Condominiums <br />at 433 Estudillo Avenue, Assessor's Parcel Number 077-0539-015-04; Owner and <br />Subdivider: 433 Estudillo LLC, a California Limited Liability Company (provides for <br />subdivision of the existing single parcel located at 433 Estudillo Avenue into 22 <br />commercial condominiums for the purpose of sale). <br /> <br />M/S/C Badger and Santos.
