She commented that the team has been without a <br />pool for two years and had hoped that the competitive swimming pool could be built <br />soon. Ordinance No. 2005-014, an Interim Urgency Ordinance Prohibiting Consideration and <br />Approval of Use Permits, Variances, Building Permits, Start of New Construction, or <br />Other Entitlements for All New Retail Sales Establishments in Excess of 10,000 Square <br />Feet in the Commercial Downtown Zoning District for a Period of Forty-Five Days and <br />Declaring this Ordinance to Be an Urgency Measure, to Take Effect Immediately, as It <br />Relates to the Preservation of Public Peace, Health and Safety (prohibits the <br />establishment of retail sales uses in excess of 10,000 square feet in downtown for forty- <br />five days to allow City staff to review and propose new zoning regulations for these <br />uses). (1005/1 009/1 098/1136/2792/2799/2805) <br /> <br />Mr. Jermanis commented that the City Council is very familiar with the concerns <br />expressed by the community regarding the downtown Albertson's site and the types <br />of uses that will be considered. In response to these concerns, staff has developed an <br />urgency ordinance for Council consideration which would place a moratorium on <br />retail uses over 10,000 square feet in the downtown area without a review process by <br />the Council. The owner of the site has been advised of this plan, and he has made a <br />commitment to find a use that would be acceptable to the community. If adopted, the <br />ordinance establishing the moratorium would be in effect for 45 days, and staff will <br />return to the Council in September for further action. <br /> <br />Public Comments on Item 10.A.: <br /> <br />Lou Filipovich, San Leandro resident, addressed the City Council regarding <br />redevelopment and its connection to this project. <br /> <br />Paul Vargas, San Leandro resident, addressed the City Council, commenting that <br />he does not feel the ordinance is necessary, and any businesses that are willing to <br />assume the risk should be allowed to do business in the City. <br /> <br />End of Public Comments <br /> <br />- Passed to Print and Adopted <br /> <br />M/S/C Stephens and Badger.
