Members commented <br />favorably regarding the developer's efforts to engage the community and to create a <br />quality project for the area. <br /> <br />. Matter of Extension of an Interim Urgency Ordinance Prohibiting Consideration and <br />Approval of Use Permits, Variances, Building Permits, Start of New Construction, or <br />Other Entitlements Related for Any New Retail Sales Use in Excess of 10,000 Square <br />Feet Within the Commercial Downtown Zoning District Within the City of San <br />Leandro (places a moratorium on the establishment of Retail Sales uses in excess of <br />10,000 square feet in the CD Zoning District while allowing City staff to review and <br />propose new zoning regulations for these uses). <br /> <br />This being the time and place for the Public Hearing on the above matter, City Manager <br />Jermanis gave an overview of the item and introduced Planning Manager Debbie <br />Pollart. Ms. Pollart provided additional information regarding the proposed extension <br />to the interim urgency ordinance. <br /> <br />The Hearing was then opened to the public. <br /> <br />Jeffrey A. Goldfarb, Rutan & Tucker (representing Red Mountain Retail <br />Group), addressed the City Council, providing a letter to the Council expressing Red <br />Mountain's opposition to the moratorium and its efforts to work in partnership with <br />the City. Mr. Goldfarb commented that Red Mountain believes the adoption of a <br />moratorium is both unnecessary and counterproductive, sends a message to the <br />business community and delays tenancy of the property. He indicated that Red <br />Mountain is willing to submit an application for a Conditional Use Permit and asked <br />that the Council not extend the moratorium. <br /> <br />
