<br />during such incapacity, but not to exceed one (1) year for anyone (1) period of such <br />incapacity. <br /> <br />Leave granted an employee under the above provisions shall not be considered sick leave <br />or deducted from accumulated sick leave. <br /> <br />When an employee has been injured in the line of duty and receives compensation in <br />accordance with the provisions of any Workers' Compensation Act of the State of <br />California, the Human Resources Director shall have submitted to him/her reports on the <br />forms in the manner prescribed. <br /> <br />An employee injured in the line of duty who requires medical care and/or physical therapy <br />shall schedule, as far as practicable, such appointments at a time so as to be as least <br />disruptive to the work schedule. <br /> <br />Modified Duty - It is the policy of the City to encourage employee's to return to work as <br />soon as possible. Every effort will be made to accommodate to an employee's medical <br />needs to ensure a speedy return to work. An injured employee is required to cooperate and <br />comply with request for information to facilitate the employees' return to work, either on a <br />modified basis or a return to full duties. <br /> <br />Industrial Disability Management Program - The parties agree to cooperate in the <br />development of an industrial disability management program. <br /> <br />Section 17. Hours of Work <br /> <br />A work week shall be computed as the number of hours customarily considered as a full <br />week's work in the classification and in the department in which the person is employed. <br /> <br />Public Works employees who are regularly assigned to work a majority of their regularly <br />scheduled shift between the hours of 4:00 p.m. and 12:00 a.m. (swing) shall receive a shift <br />differential of one hundred seventy-five dollars ($175.00) per month. Public Works <br />employees who are regularly assigned to work a majority of their regularly scheduled shift <br />between the hours of 12:00 a.m. and 8:00 a.m. (graveyard) shall receive a shift differential <br />of two hundred ($200.00) per month. Employees who are regularly assigned to provide <br />relief assignments for swing and/or graveyard shift(s) shall receive a shift differential for <br />the time spent working on such shift(s). <br /> <br />It is understood that such shift differential shall be included in the computations based upon <br />the base rate for purposes of overtime compensation, holiday, sick leave and vacation leave <br />pay where the employee has worked a shift which requires payment of the differential, as <br />provided in the preceding paragraph, for thirty (30) days or more. <br /> <br />The setting of work hours is based upon the operational needs of the department. An <br />employee's work hours may be changed based upon the operational needs of the <br />department. In the event an employee's work schedule is to be changed; the employee <br />shall be given seven (7) working days advance notice. <br /> <br />15 <br /> <br />
