Ayes: 6; Noes: 0; Absent: 1 (Nardine) <br /> <br /> <br />B.Matter of Annual Reporting for the 911 Revenue Program (provides report on the 911 <br />Revenue Program and recommends increase in the Emergency Communication System <br />Access Fee). <br /> <br />This being the time and place for the Public Hearing on the above matter, Assistant <br />City Manager Steve Hollister gave background on the matter and introduced Deputy <br />Finance Director Carla Rodriguez. Ms. Rodriquez gave a short PowerPoint <br />presentation on the annual reporting for the 911 Revenue Program, including a <br />recommendation to increase the fee by the CPI rate of 2.93%. <br /> <br />The Hearing was then opened to the public. <br /> <br />Lou Filipovich, San Leandro resident, <br /> addressed the City Council, commenting that <br />he believed the 911 Fee is a tax rather than a fee. <br /> <br />There being no further comments from the public, and without objection, the Public <br />Hearing was closed. <br /> <br />City Attorney Jayne Williams provided an update to the Council on litigation involving <br />the City of Union City’s 911 Fee. Ms. Williams reported that the Alameda County <br />Superior Court granted the cellular phone companies’ motion for summary judgment, <br />and the City of Union City has decided to appeal the ruling. She pointed out that the <br />Alameda County Superior Court ruling is contrary to a ruling by the Stockton Court, <br />which ruled in favor of the City of Stockton. Ms. Williams noted that the courts have <br />not enjoined any cities to refund 911 fees collected thus far. <br /> <br />? <br /> Resolution No. 2006-040 <br />, Resolution Approving and Confirming the Annual <br />Reporting for the 911 Revenue Program [recommends an increase to the <br />Emergency Communication System Access Fee (911 Fee) by the Consumer <br />Price Index (CPI) rate of 2.9%].
