<br />9 <br /> <br />City of San Leandro <br />Community Development Department <br />Planning Services Division <br />Staff Report <br /> <br />DATE: <br /> <br />June 22, 2006 <br /> <br />Planning Commission <br /> <br />Elmer Penaranda, Planner II ~ <br /> <br />SUBJECT: Continued Matter PLN2005-00141; Rezone from RM1800 Residential Multi- <br />Family District to RM2500(PD) Residential Multi-Family, Planned Development <br />Overlay District; Planned Development and Vesting Tentative Tract Map to <br />construct a subdivision consisting of six, detached, three-story, single-family <br />residences. Each unit would comprise approximately 1,455 square feet of living <br />area, which includes three bedrooms and three baths. Each unit would have an <br />attached two-car garage. 1537 Hays Street; Alameda County Assessor's Parcel <br />Numbers 75-12-7; D. Langon, Langon Homes (applicant and property owner). <br />Continued from the June 8, 2006 Planning Commission Meeting). <br /> <br />TO: <br /> <br />FROM: <br /> <br />SUMMARY AND RECOMMENDATION <br /> <br />This matter was continued from the June 8, 2006 Planning Commission meeting. After the public <br />hearing was closed and after the Commission's discussion the motion to recommend approval of <br />the rezoning, the planed development and the vesting tentative map to the City Council ended in <br />a tie, three votes for and three votes against the motion. When a motion does not pass or fail, and <br />there is no action on the motion in the following 15 days, the motion is automatically denied <br />administratively. Instead of this outcome, the Commission asked the applicant if he would be <br />willing to mitigate some of the design concerns addressed in the discussion and come back to the <br />Planning Commission with revised plans. Mr. Langon, the applicant, replied affinnatively and <br />stated that the architect would prepare different drawings to resolve some of the concerns. Thus, <br />the Commission approved the motion to continue the matter to the Commission's June 22,2006 <br />meeting. Ms.Pollart, the Planning Commission Secretary, announced that since the matter was <br />continued to a date certain, no one, including the applicant or the members of the public would <br />receive a notification by mail of the continued hearing. The Commission's motion in effect was <br />the notification of the hearing. <br /> <br />Since the continuance, the applicant has revised the two front units facing Hays Street to include <br />a stronger fayade, including larger windows and a shed roof that runs the length of the elevation. <br />In addition, more detailed drawings were prepared for the proposed arbor over the entry <br />driveway. A detailed landscape plan has been prepared. The additional massing/view study <br />taking into account the Garden Terrace Condominiums and the proposed residential project were <br />not completed at the time this report. The applicant, however, will be prepared to show the new <br />massing/view study to the Planning Commission and general public at the Commission's <br />meeting. <br />
