<br />1537 Hays Street; PLN2005-00141 <br /> <br />6 <br /> <br />September 5, 2006 <br /> <br />Code Compliance Review <br />Not applicable <br /> <br />Board/Commission Findine:s <br />The Planning Commission reviewed this application on June 8 and June 22, 2006. At the <br />latter meeting, the applicant and architect responded to the Planning Commission's <br />recommendations in enhancing the front-facing Hays Street elevations, the entry arbor <br />design, and the on-site landscaping to include tree planting along the southerly edge of the <br />site. The Plarming Commission has recommended approval of the rezone, the planned <br />development, the vesting tentative map to develop a new residential subdivision, subject <br />to the attached recommended conditions and findings. <br /> <br />Summary of Public Outreach Efforts <br />Under the Council's directive to provide public outreach early on in the process, the <br />developer mailed invitations to property owners within 300 feet of the subject property <br />inviting them to a community meeting on the evening of Wednesday, November 30, 2005 <br />at the Boy Scouts Building on Davis Street to discuss the proposed plans. The purpose of <br />the meeting was to present his preliminary plans and to solicit community comments <br />prior to submittal of a formal application. Approximately six persons attended the <br />meeting, not including the developer, architect and City staff. There were no concerns <br />expressed by persons that attended the meeting. <br /> <br />The developer also met with the interested Garden Terrace owners on Tuesday, June 20, <br />2006, prior to the continued Planning Commission hearing of June 22, 2006. The purpose <br />of the meeting was to receive concerns and suggestions from the Garden Terrace owners. <br />The owners suggested revising the plans so that four of the six units would be on the <br />northerly half of the site and the southerly half would have only two units. The developer <br />and architect studied the alternative and found the suggested revised plan to be <br />problematic. Rearranging the units in that configuration resulted in the layout having <br />insufficient setbacks and inadequate driveway widths for circulation and access into the <br />parking spaces. <br /> <br />The Planning Commission meetings on January 26, 2006 and June 8,2006 were noticed <br />with a legal advertisement in the Daily Review newspaper, posting of the property on <br />nearby utility poles, and notification of property owners within the 300-foot radius from <br />the subject property. Additionally, at the June 22 meeting, the Plarming Commission <br />allowed additional public comments. <br /> <br />On July 26, 2006 an informal meeting with the Garden Terrace owners and the applicant <br />was conducted by City staff. The purpose of the additional outreach with the neighbors and <br />the association was to look at possible measures that the applicant could take to address the <br />concerns expressed by Garden Terrace property owners over privacy, views and property <br />values. Design revisions were discussed to address the Garden Terrace owners' concerns. <br />The following revisions and other measures have been agreed to by the applicant: <br /> <br />. Increase the side yard setback adjacent to the Garden Terrace condominiums from <br />10 feet to 12.5 feet. <br />
