name, truck number if applicable, time of delivery, tonnage delivered, vehicle license number, person <br />receiving the delivery. <br />Substitute Scales <br />To the extent that all the scales are inoperable, being tested, or otherwise unavailable, the Contractor shall <br />substitute either portable scales or use public scales until the permanent scales are replaced or repaired. <br />The Contractor shall arrange for the scale to be repaired or temporarily substitute scales to be used as <br />soon as possible, and in any event, within 48 hours after failure of the permanent scales. <br />Estimating Volumes <br />Pending substitution of portable scales, Contractor shall estimate the quantity of materials being delivered <br />to the processing facility and residue and recovered materials being transported from the processing <br />facility, on the basis of delivery truck and transfer trailer volumes, tare weight, broker's weigh records, and <br />data obtained through historical information from the processing facility and purchasers of recovered <br />materials using a methodology acceptable to the City. These estimates shall take the place of actual <br />weighing and shall be the basis for records while scales are inoperable. <br />Testing of Scales <br />The Contractor shall test and calibrate all scales in accordance with applicable law, but at least every <br />twelve months. Prior to any test, it shall provide at least five days notice thereof to the City. Upon City <br />request, it shall provide the City with copies of the test results. <br />Processing Equipment <br />Contractor shall provide processing equipment in number and capacity to efficiently perform the work <br />required by the Agreement. The Contractor agrees to maintain each piece of equipment used by it in the <br />performance of this Agreement in good order and repair, Contractor shall have available sufficient backup <br />equipment to respond to mechanical failures or other difficulties. <br />DRAFT 1/24/00 Page 11 of 11 <br />
