financial records available to the City during Contractor's office hours upon City request. <br />Tours of Facility <br />Upon 24 hours request of the City, Contractor shall provide public tours of the facility. Such tours shall not <br />unreasonably disrupt facility operation. Contractor shall not be required to conduct such tours more <br />frequently than once per week; provided that tours may be required once per day during the first year of <br />operation, by appointment. City shall not be charged for labor, overhead, overtime, or any other costs <br />associated with such tours. As part of such tours, Contractor shall prepare (subject to City's approval of <br />text and format) and shall distribute an educational brochure, printed on recycled paper, on conservation, <br />recycling, and general solid waste management programs. <br />Personnel <br />The Contractor shall engage and train qualified and competent employees, including managerial, <br />supervisory, clerical, maintenance, and operating personnel, in numbers necessary and sufficient for <br />facility operations and to perform the Contractor's obligation under this Agreement. The Contractor shall <br />train such staff to perform their work in a safe and efficient manner in accordance with the health and safety <br />plan in the facility's operations and maintenance manual. <br />Recovery Standards <br />The Contractor shall use reasonable business efforts to maximize the recovery of delivered materials in a <br />manner acceptable to receive diversion credit under AB 939. <br />Finished Product Standard <br />The processed recyclables and/or the finished product shall comply with all applicable laws, ordinances, <br />regulations, and permit conditions. <br />Transportation of Residue <br />The Contractor shall transport and deliver all Recycling Residue to a disposal facility after its delivery to the <br />processing facility in no event longer than required by applicable law. The Contractor shall select routes <br />from the processing facility to the disposal facility which minimize inconvenience and disturbance to the <br />public and comply with permits and applicable law. Contractor shall enclose or cover all vehicles <br />transferring residue from the facility to prevent spillage. <br />Weighing <br />The Cantractor shall develop and manage a system of weighing materials received from collection vehicles <br />and tracking recovery of incoming materials and disposition of residue. The Contractor shall record <br />tonnages of material received. At a minimum, the recorded data must indicate for each delivery, hauler's <br />DRAFT i/24/nn Page 10 of 11 <br />
