B. Absence of Litigation. There is no litigation pending on the Signature Date in any court challenging <br />the award or execution of this Agreement or seeking to restrain or enjoin its performance. <br />C. Verifica 'on of Insurance Covera a and Faithful Performance Bond. The Contractor shall submit <br />and maintain tothe satisfaction ofthe City, endorsements of insurance coverage and faithful performance bond <br />pursuant to this Agreement <br />D. Execution of Nate: Payment of Certain Costs. The Contractor shall have delivered to the City a fully <br />executed promissory note and cash payment as provided herein. <br />3.13 PREVAILING WAGES <br />At all times during the Term of this Agreement, the Contractor shall pay prevailing wages as prescribed by <br />the Labor Code in Sections 1770 et seq. <br />ARTICLE 4. SERVICES TO BE PERFORMED BY CONTRACTOR <br />4.1 SOLID WASTE <br />The Contractor shall provide Solid Waste, Recyclables and Green Waste collection, processing, transfer <br />and Disposal services originating from or generated within the City as defined in this Agreement, including, <br />but not limited to, paying the costs associated with all labor, insurance, supervision, machinery and <br />equipment, plant buildings, Tipping Fees, permits, licenses, Disposal facilities, trucks and any other tools, <br />equipment, accessories and things necessary to perform the services herein for the duration of this <br />Agreement, including obtaining and complying with all permits, licenses and approvals, landfill capacity and <br />operations, landfill closure and post-closure maintenance and remediation in consideration of the right to <br />charge and collect the Rates and Special Charges in the amounts and on the terms set forth in this <br />Agreement. <br />4.2 HAZARDOUS WASTE, BIOHAZARDOUS WASTE, BIOLOGICAL WASTE AND SLUDGE <br />The Contractor shall not be required to collect and dispose of Hazardous Waste, Medical and Infectious <br />Waste, and Household Hazardous Waste, except waste oil collected through the Recyclables collection <br />program, but may offer such service in the City. All such collection and Disposal for such of waste, when <br />done by the Contractor, shall be in strict compliance with all federal, state and local laws and regulations. <br />Revenues derived from such services shall be considered gross revenues of this Franchise. Charges for <br />these services are Special Charges. <br />4.3 DANGEROUS ANIMALS AND SOLID WASTE, RECYCLABLE MATERIALS OR GREEN_ <br />WASTE COLLECTION <br />Employees ofthe Contractor shall not be required to expose themselves to the danger of being bitten by <br />vicious animals in order to accomplish Solid Waste, Recyclable Materials or Green Waste collection.
