the City Representative of such condition and of Contractors inability to make collection because of such <br />conditions. <br />4.4 OPERATIONAL STANDARDS <br />Contractor shall accomplish all work, specified under this Agreement, in a thorough and professional <br />manner so the residents and businesses within the City are provided reliable, courteous and high-quality <br />Franchise Services. The enumeration of, and specification of requirements for, particular aspects of <br />service quality shall not relieve the Contractor of the duty of accomplishing all other aspects in the manner <br />provided for in this Article, whether such other aspects are enumerated elsewhere in this Agreement or not <br />Contractor shall perform all work in accordance with the operational standards in Exhibit E. <br />4.5 COMPLIANCE WITH STATE, FEDERAL AND MUNICIPAL LAW <br />The Contractor shall comply with all applicable City, State and federal laws now or hereafter in effect, <br />relating to the services provided under this Agreement including, but not limited to, all environmental laws <br />and all laws related to the employment or protection of employees. <br />4.6 RESIDENTIAL SOLID WASTE, RECYCLABLE MATERIALS, AND GREEN WASTE SERVICES <br />A. neral. The Contractor shall collect Solid Waste, Recyclable Materials and Green Waste from <br />all Single Family Residences within the City. The Contractor shall have the exclusive right to <br />collect, process and dispose of Solid Waste, Recyclable Materials and Green Waste except as <br />excluded under the Franchise. Unlimited Green Waste collection shall commence on or about <br />April 1, 2000. Single Stream Recycling shall commence on or about June 1, 2000. Automated <br />Curbside Service of Residential Solid Waste shall commence on or about October 1, 2000. <br />13. Recvclable Materials. The Contractor shall collect all Recyclable Materials. As it becomes <br />appropriate or beneficial, at the direction of the City Representative the term "Recyclable <br />Materials", as described in Article 1, may be edited, changed, expanded, or reworded. Likewise, if <br />it becomes unfeasible or financially impractical to continue collection of any one of the above <br />items, the Contractor may petition the City Representative for approval to discontinue collection of <br />those items as Recyclables or dispose of those collected items. The City is under no obligation to <br />grant such petition. Where the City requests an increase in the items collected which affects the <br />operational casts of the Contractor, the Contractor and the City Representative shall negotiate and <br />approve an appropriate adjustment in the Rates paid to the Contractor for that limited purpose and <br />to insure a fair and reasonable rate of return to the Contractor. <br />C. Green Waste Program. The Contractor agrees to develop, implement, operate and participate <br />(locally and regionally) in mulching, composting, transformation or other programs toward <br />maximizing the City's Green Waste diversion. In particular, the Contractor agrees to accomplish <br />the programs set out in this Agreement and to be aggressive in the pursuit of new opportunities to <br />divert Green Waste from Disposal.l3est efforts shall be made by the Contractor to divert as much <br />r:~~~n~-,~,~n~a..~ o2rovoo Page 17 of 59 <br />
