B. Collection Monitoring. The Contracts' shall monitor its collection of Recyclable Materials and <br />Green Waste to identify occurrences of, and to prevent, contamination of Recyclable Materials and Green <br />Waste. The Contractor shall allow a person designated by the City Representative to ride with the <br />Contractor's collection vehicles on any route or routes without prior notification. <br />9.6 INSPECTION BY THE CITY <br />The City Representative shall have the right to observe and review the Contractor's operations and <br />equipment, and to enter premises for the purposes of such observations and review at any time without <br />prior notification. <br />9.7 PERIODIC REVIEW <br />The City may periodically review the performance of the Contractor based on Customer complaints, timely <br />payment of sums due, statistical reporting, program progress, etc. This review may be conveyed to the <br />Council, and the Contractor may review the draft report and submit its own statement <br />9.8 PERFORMANCE REVIEW <br />The City will undertake a "Performance Review° of the Contractor at five (5) year intervals during the Term <br />or renewal Term hereof. Such Review shall certify that the Contractor has materially complied with all <br />provisions of the Agreement and substantially met the Operational and Performance Standards herein. <br />A. Scope of Performance Review. The Performance Review shall: <br />Be performed by a qualified firm under contract to the City. The qualified firm shall be <br />selected by the City with recommendations from the Contractor. <br />ii. The Contractor shall bear the reasonable cost of the Performance Review. <br />iii. The Performance Review shall address <br />a. Compliance with the temu of this Agreement and Applicable Laws. <br />b. Compliance with the Operational Standards in Exhibit E. <br />The Contractor shall cooperate fully with the Performance Review, and provide within sixty (60) days of <br />request, all operational, financial and other information deemed reasonable or convenient by City or the <br />firm for purposes of conducting the Performance Review. The Contractor's failure to cooperate or provide <br />all requested information shall be considered an event of default <br />A. Changes to Operations.
