iv. Pollution and/or Environmental Impairment Liability and/or Errors & Omissions. <br />B. Minimum Limits of Insurance. The Contractor shall maintain limits no less than: <br />General Liability: $5,000,000 combined single limit per occurrence for bodily injury, <br />personal injury and property damage. If Commercial General Liability Insurance or other <br />form with a general aggregate limit is used, either the general aggregate limit shall apply <br />separately to this projectnocation or the general aggregate limit shall be twice the required <br />occurrence limit <br />ii. Automobile Liability: $3,000,000 combined single limit per accident for bodily injury and <br />property damage. <br />iii. Workers' Compensation and Employer's Liability: $1,000,000 each accident, $1,000,000 <br />policy limit bodily injury or disease, $1,000,000 each employee bodily injury by disease. <br />iv. Pollution and/or Environmental Impairment liability and/or Errors and Omissions: <br />$3,000,000 each occurrence/$10,000,000 policy aggregate covering liability arising from <br />the release of waste materials and/or irritants, contaminants or pollutants. Such coverage <br />shall, if commercially available, without involvement of the City, automatically broaden in <br />its form of coverage to include legislated changes in the definition of waste materials <br />and/or irritants, contaminants or pollutants. The policy shall stipulate this insurance is <br />primary and no other insurance carried by the City will be called upon to contribute to a <br />loss suffered by the Contractor hereunder and waive subrogation against the City and <br />other additional insureds. <br />C. Deductible and Self-Insured Retentions. Any deductibles orself-insured retentions must be <br />declared to and approved by the City. At the option of the City, either the Insurer shall reduce or eliminate <br />such deductibles orself insured retentions as respects the City, its officers, officials, employees and <br />volunteers; or the Contractor shall provide evidence satisfactory to the City guaranteeing payment of <br />losses and related investigations, claim administration and defense expenses. Notwithstanding the <br />foregoing, the City may elect not to accept any deductibles orself-insured retentions offered by the <br />Contractor. <br />D. Other Insurance Provisions. <br />The policies are to contain, or be endorsed to contain, the following provisions: <br />a. The City, its officers, officials, employees and volunteers are to be covered as <br />insureds with respect to liability arising out of automobiles owned, leased, hired or <br />borrowed by or on behalf of the Contractor; and with respect to liability arising out <br />of work or operations performed by or on behalf of the Contractor including <br />materials, parts or equipment furnished in connection with such work or <br />I:~wpd~scna~al;m~'ixi,chisanewx.wpa ovo~ioo Page 41 of S9 <br />
