<br />EXHIBIT D <br /> <br />GENERAL FEDERAL/STATE CONDITIONS <br /> <br />COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) <br />(Service Agreement) <br /> <br />I. GOVERNMENTAL REGULATIONS. To the extent that this Agreement may be funded by <br />fiscal assistance from another governmental entity, Consultant shall comply with all <br />applicable rules and regulations to which City is bound by the terms of such fiscal assistance <br />program. In particular, Consultant agrees to comply with all applicable provisions of the <br />Housing and Community Development Act of 1974 (Public law 93-383) and regulations <br />promulgated pursuant thereto. <br /> <br />2. RECORDS. Records must be kept accurate and up-to-date. Consultant's records shall be <br />made available for review by the City, HUD or their designee. Consultant shall be <br />responsible to maintain, for not less than five (5) years after completion of this Agreement, <br />all records pertaining to this Agreement, including Subconsultants and expenditures, and all <br />other financial and property records. This section does not supersede Section 9 of the <br />Agreement. <br /> <br />3. AUDITS AND INSPECTIONS. <br /> <br />(a) Consultant shall at any time during normal business hours and as often as the <br />City, HUD and the Comptroller General of the United States may deem <br />necessary, make available to their representatives for examination all of <br />Contractor's record with respect to all matters covered by this Agreement and <br />shall permit these representatives to audit, examine and make excerpts or <br />transcripts from such records, and to make audits of all documents and conditions <br />relating to this Agreement. All costs are subject to the eligibility requirements of <br />HUD. <br /> <br />(b) Consultant shall permit and facilitate observation and inspection of the work and <br />records at Contractor's principal office and job site by City, its employees and <br />public authorities during reasonable business hours. <br /> <br />This section does not supersede Section 9 of the Agreement. <br /> <br />4.
