<br />2. During the performance of this Agreement, Contractor agrees as follows: <br />a. Consultant will not discriminate against any employee or applicant <br />for employment because of race, color, religion, sex, sexual <br />orientation, handicap, age, or national origin. Consultant will take <br />affirmative action to ensure that applicants for employment are <br />employed, and that employees are treated during employment, <br />without regard to their race, color, religion, handicap, sex, sexual <br />orientation, age, or national origin. Such action shall include but <br />not be limited to the following: employment; upgrading; demotion <br />or transfer; recruitment or recruitment advertising; layoff or <br />termination; rates of payor other forms of compensation; and <br />selection from training, including apprenticeship. This section <br />does not supersede Section 7.5 of the Agreement. <br /> <br />Consultant will incorporate the above Affirmative Action <br />provisions in all subcontracts for work covered by this Agreement. <br /> <br />(b) Minority and Female-owned Business Enterprises <br /> <br />I. In connection with the performance of this agreement, Consultant shall <br />comply with the City and Federal Governments' current policies and use <br />its best efforts to obtain the maximum utilization of minority-owned <br />business enterprises based in San Leandro and ensure that minority and <br />female-owned enterprises based in San Leandro shall have maximum <br />practicable opportunity for Subconsultant work under this Agreement. <br /> <br />2. Consultant shall insert similar provisions in all subcontracts for work <br />covered by this Agreement. <br /> <br />(c) General employment Provisions Relating to Handicap/Disability Discrimination <br />for CDBG Consultants <br /> <br />I. General prohibitions against employment discrimination. <br /> <br />a. No qualified individual with a handicap or a disability shall, solely <br />on the basis of such handicap or disability, be subjected to <br />discrimination in employment by a Consultant receiving Federal <br />financial assistance as part ofthe CDBG program. <br /> <br />b. The Consultant may not limit, segregate, or classify applicants or <br />employees in any way that adversely affects their opportunities or <br />status because of handicap or disability. <br /> <br />c. Prohibition against discrimination in employment by the <br />Consultant applies to the following activities: recruitment, <br />advertising, processing of applications for employment; hiring, <br /> <br />Senior Center <br />Project No. 210-18-116 <br />CDBG - Rev. 3/15/04 <br /> <br />2/6/06 <br />Page 32 of 39 <br />
