<br />grading of the subject site shall require Board of Zoning Adjustments review of <br />the changes at a public hearing. <br /> <br />B. The subject residence and in-law unit shall be limited to single-family occupancy <br />in each dwelling, only. For the purposes of this condition, installation of any <br />appliances for cooking, including, but not limited to a stove, hot plate or <br />microwave oven, in any room other than the individual kitchen in the existing <br />dwelling unit within the single-family home, shall be deemed the creation of an <br />additional kitchen and therefore creation of an additional dwelling unit. <br />Specifically, bedrooms or any room other than the designated kitchen in the <br />homes on the property shall not have any other kitchen and shall not be <br />acknowledged as a separate dwelling unit at the subject property. Prior to issuance <br />of building permits, the property owner shall have notarized and filed with the <br />County Assessor's Office a Deed Restriction of Use, limiting the main residence <br />and the in-law unit to a single-family use for each structure. Planning staff shall <br />prepare the document for the applicant. <br /> <br />C. Pursuant to Zoning Code Section 2-520 (Maximum Dwelling Unit Occupancy), a <br />zoning permit shall be required for occupancy of any of the proposed dwelling <br />units by more than ten (10) persons eighteen (18) years or older. <br /> <br />D. Construction of the project shall remain in substantial compliance with the <br />approved exhibits and plans. Any change to the project design, materials or colors <br />shall be subject to the review and approval of the Zoning Enforcement Official <br />who may administratively approve or require review by the Board of Zoning <br />Adjustments as a modification to appropriate application approval listed above. <br /> <br />III. PROJECT SITE IMPROVEMENTS <br /> <br />A. All garage doors shall be roll-up sectional type. <br /> <br />B. All garages shall have electronic, remote control garage door openers. <br /> <br />C. Within the habitable areas of the dwellings, exterior sound transmission control <br />measures shall be provided to prevent the intrusion of exterior noise. Interior <br />noise levels attributable to exterior sources shall not exceed 45 dBA in any <br />habitable room with windows closed. <br /> <br />D. Prior to approval of the final building plans for building permits, the developer <br />shall submit evidence that the residence complies with Title 24 Code, to the <br />satisfaction of the Chief Building Official. <br /> <br />E. All site landscaping shall be installed, to the satisfaction of the Community <br />Development Director, prior to issuance of Certificate of Occupancy. <br /> <br />Revised Conditions of Approval <br />PLN2005-00063 <br /> <br />December 4, 2006 <br />Page 3 of8 <br />
