<br />MINUTES Page 4 <br />City of San Leandro City Council, San Leandro Redevelopment Agency, and San Leandro Hillside Geologic Hazard <br />Abatement District Joint Meeting-July 17,2006 <br /> <br />(existing) and the proposed two-family home into a condominium for sale as three <br />individual units; Site Plan Review, to add a second story to the existing one-story <br />single-family home and to construct a new additional two-family home towards the <br />rear of the property at 13140 Neptune Drive; Assessor's Parcel Number 79A-565-41; <br />J. Chen (Applicant/Property Owner). Continued from June 19, 2006. <br /> <br />Mayor Young stated that this is a continued discussion from the City Council meeting <br />on June 19, 2006. At that meeting, the public hearing was closed. Following staffs <br />presentation, the Council could reopen the public hearing ifit chooses to do so. <br /> <br />Mr. Jermanis noted that at the June 19 public hearing, the Council raised several <br />questions regarding the definition of condominium ownership. <br /> <br />Planning Manager Debbie Pollart gave a short PowerPoint presentation, reviewing the <br />details of the project, reviewing the appeal by the Marina Action Committee and <br />Mulford Gardens Improvement Association, responding to questions raised by the <br />Council at the June 19 public hearing, and outlining the revisions to the Conditions of <br />Approval. <br /> <br />Staff responded to clarifying questions from the Council. <br /> <br />At the request of the Council, the public hearing was reopened. Mayor Young noted <br />that many of the speakers also spoke during the public hearing held on June 19 and <br />adjusted the time allotted to the speakers to two minutes. <br /> <br />Audrey Albers, San Leandro resident, addressed the City Council, commenting <br />that the Zoning Code does not address condominiums in the RO District. Ms. Albers <br />stated there is nothing in the Zoning Code which prohibits the Council from banning <br />condominium conversions in the RO District. <br /> <br />John Manuel, representing the Appellants, addressed the City Council, requesting <br />that the project be referred back to the Board of Zoning Adjustments. Mr. Manuel <br />commented that residents of Mulford Gardens should develop their own CC&Rs and <br />seek legal counsel to represent their interests and sort through existing zoning laws. <br />He stated that the rights of the residents have been ignored by the City. <br /> <br />James Chen, Applicant, addressed the City Council, commenting that he has met all <br />conditions to comply with the approval process and requesting that he be granted the <br />same treatment as other applicants of similar projects. Mr. Chen assured his <br />neighbors that his family plans to live in the new home, grow roots here and become <br />active, contributing members of the community. <br /> <br />Hoang Ph an, San Leandro resident, addressed the City Council, expressing support <br />for the project. <br />
