<br />MINUTES Page 5 <br />City of San Leandro City Council, San Leandro Redevelopment Agency, and San Leandro Hillside Geologic Hazard <br />Abatement District Joint Meeting-July 17, 2006 <br /> <br />Yvette Rice, San Leandro resident, addressed the City Council, commenting that <br />parcels in Mulford Gardens should remain spacious. Ms. Rice asked that the Council <br />consider the number of residents speaking in opposition versus the number speaking <br />in favor of the project. <br /> <br />David Sequeira, San Leandro resident, addressed the City Council, commenting <br />that Mulford residents are losing their privacy rights due to the development of two- <br />story homes and multiple units on neighboring lots. <br /> <br />Joseph Tezeno, San Leandro property owner, addressed the City Council, <br />commenting that he believes it is better to have multiple owners of a large lot than <br />one owner. Mr. Tezeno stated he is converting rental units on his property to <br />ownership units. <br /> <br />Lou Filipovich, San Leandro resident, addressed the City Council, commenting on <br />items unrelated to the matter. <br /> <br />There being no further comments from the public, and without objection, the public <br />hearing was closed. <br /> <br />Vice Mayor Grant indicated her hesitancy to move forward with the policy statement <br />on condominiums in the RO District at this time. She expressed appreciation for the <br />property owner's efforts in working with staff to make the project more acceptable to <br />the neighbors, and she stated she liked the changes that were made. Councilmember <br />Grant commented that she would not be opposed to having the project go back to the <br />BZA due to the substantive changes. <br /> <br />Councilmember Santos pointed out that the applicant has made efforts to reduce the <br />size of the project and increase setbacks. He commented on other projects in the RO <br />District which were previously approved and noted there is so much precedent for this <br />type of project in the Mulford area. Councilmember Santos noted the neighbor across <br />the street supports the project. He sta~ed that he was asked to raise the issue of the <br />size of the units proposed for development and whether they should receive additional <br />review or whether revisions should be made to the size of units allowed in the RO <br />District. <br /> <br />Councilmember Badger requested clarification on the ownership of the property. City <br />Attorney Jayne Williams pointed to a memorandum from the City Attorney's Office <br />to the Planning staff on page 91 of the agenda which provides a definition of a <br />condominium. She noted that condominium owners have a common interest in the <br />property and individual interest in the units, and CC&Rs would regulate their <br />common interest responsibilities. <br /> <br />Mayor Young commented that this is the first time in her many years of experience <br />that this type of project has been appealed. She expressed concern about referring the <br />matter back to the BZA, noting the BZA members are the Council's representatives <br />
