Resolution No. 2004-079, Resolution Approving Plans and Specifications and Calling <br />for Bids for Westgate Parkway Extension to Williams Street (Stage 1), Project No. 04- <br />144-39-003, ACTIA Project No. 18 (provides for extension of Westgate Parkway fi-om <br />Davis Street to Williams Street along the eastern edge of the Westgate Shopping <br />Center). Bid opening date is June 21, 2004. Funding: Approved as part of the Fiscal <br />Year 2002-03 CIP budget. (2930/3023) <br /> <br />Councilmember Santos expressed concenl regarding the sound reduction capability and <br />the aesthetics of the proposed sound wall. Matter of Property Owners' Hearing Regarding Enlinent Domain Proceedings for <br />Acquisition of a Portion of the Properties Located at: Williams Street, APN 079A-0375- <br />007 - 36, Property Owner: Union Pacific Railroad Company; 1919 Williams Street, <br />APN 077 A-0700-090-04, Property Owner: Case Equipment Company; 1944 Williams <br />Street, APN 079A-0375-007-33, Property Owner: Insured Transporters, Inc.; 1950 <br />Williams Street, APN 079A-0375-007-12, Property Owner: AMB Partners II LP; and <br />1919 Davis Street, APN 079A-0375-007-37 and 079A-0395-006-11, Property Owner: <br />Wal-Mart Real Estate Business Trust, for Construction of a New Roadway Extending <br />Westgate Parkway to Williams Street (authorizes the City Attorney to petition the court <br />to begin enlinent domain proceedings for the acquisition of a portion of the property <br />located at Williams Street, 1919 Williams Street, 1944 Williams Street, 1950 Williams <br />Street, and 1919 Davis Street, for construction of a new roadway extending Westgate <br />Parkway to Williams Street). <br /> <br />Lou Filipovich, 15376 Laverne Drive, addressed the City Council, stating that he <br />would not be able to comment about the property owner comments and City Council <br />discussion on this nlatter. He cautioned the Council regarding the misuse of eminent <br />domain authority. <br />
