Ms. Battenberg gave a short PowerPoint presentation providing details on the proposed Emergency Communication System Access Fee ordinance and resolution. The Hearing was then opened to the public. Shiyama Clnnie, SBC, addressed the City Council, clarifying that SBC is not opposed to the 911 Fee. She commended the City of San Leandro for working with SBC in considering their model ordinance. Ms. Clunie commented that some wireless phone cOlllpanies have filed lawsuits against 911 fees in other cities, and SBC feels it may need to follow suit. She stated that SBC wants to ensure that the laws are applied equally to both wireless and wired line companies. There being no further comments fronl the public, and without objection, the Public Hearing was closed. Mr. J ermanis clarified that the recoDlmendation before the Council is to take action on the ordinance that would provide the structure for the Emergency Communication System Access Fee. The actual fee will be adopted by resolution and will be presented to the Council for approval in September. Councilnlember Grant asked about the process for collecting the fee from the telephone service providers. Mr. J ermanis indicated that the process would be similar to the collection of the Utility Users Tax. Ms. Battenberg stated that the City would allow the telephone service providers to assess a service charge of up to one-eighth of one percent on the amounts collected. . Matter of a Resolution Amending Title 6, Chapter 4 of the San Leandro Administrative Code Relating to Fiscal Year 2004-05 Fees for San Leandro Marina Berth Rental (approves proposed adjustments to City berth rental rates and service charges for fiscal year 2004-05 effective August 1,2004). This being the time and place for the Public Hearing on the above matter, City Manager J erm ani s gave background on the item and introduced Public Works Services Director Bob Rockett. Mr. Rockett and Marina Supervisor DelMarie Snodgrass gave a short PowerPoint presentation providing an update on the actions taken since the matter was last considered by the Council and outlining the proposed rate increase. The Hearing was then opened to the public.
