<br />MINUTES <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-March 3, 2003 <br /> <br />Page 5 <br /> <br />during rush hour. Mr. Rawlis expressed concern regarding impatient and discourteous drivers <br />and suggested everyone try walking, bicycling or taking public transportation in their city <br />once a month to gain a different perspective. <br /> <br />6. CITY MANAGER AND CITY ATTORNEY REPORTS AND COMMENTS <br /> <br />City Manager Jermanis stated the Police Department would look into the alleged fraud on the <br />part of the former officers of the HOA. Mr. Jermanis reported Stericycle has applied for a <br />permit to expand the business. He indicated the Police Chief is aware of the problems with <br />the individual on Timothy Drive and will also look into the problem of dogs kept in <br />unsanitary conditions. Mr. Jern1anis addressed the issue of Walnut Drive, pointing out it was <br />an unimproved street when it was annexed to the City, and the property owners have the <br />obligation to make or pay for ilnprovements or to upgrade its condition to a standard city <br />street. Mr. J ermanis noted Councilmember Santos has been working with Walnut Drive <br />residents and that he and Councilmember Santos will meet with the residents to try to come to <br />resolution on the issue. <br /> <br />Councilmember Grant asked that in staffs report to Council on the BOA fraud issue the <br />question of the City's responsibility/liability also be addressed. Councilmember Grant noted <br />the City's extensive involvement with, and reliance on, HOAs. City Attorney Randolph <br />added the City does not have enforcement authority over individual CC&Rs, but the City can <br />pursue fraud and other criminal charges through the Police Department and forward them to <br />the District Attorney for prosecution. <br /> <br />The City Council recessed from 8:50 p.m. to 9:03 p.m. <br /> <br />7. MOTION TO AMEND AGENDA <br /> <br />City Council Members or staff have an opportunity at this time to request that an item be <br />removed from the Consent Calendar for the presentation of a staff report or other special <br />consideration. Members of the Public may request, by filing a speaker card, the opportunity <br />to address the City Council regarding items remaining on the Consent Calendar. Items <br />remaining on the Consent Calendar will be considered for approval under one motion. <br /> <br />- Motion to arnend the agenda by removing Items 8.B., 8.C. and 8.D. from the Consent <br />Calendar to Item 9, Items Removed from Consent Calendar. <br /> <br />M/S/C Badger and Glaze. Ayes: 7; Noes: 0 <br /> <br />8. CONSENT CALENDAR <br /> <br />Consent Calendar items are considered for approval by the City Council with one single <br />action. As described above in Item 7, Motion to Amend Agenda, the City Council n1ay <br />remove items from the Consent Calendar for purposes of presentation or discussion. <br />
