(Continued from <br />July 7, 2003.) (2930/2999) <br /> <br />Vice Mayor Glaze commented that the input he has received from residents on <br />Alternative 1 has been positive. Vice Mayor Glaze asked if the public was informed <br />about the addition of Alternative 4 as a potential future phase. Engineering and <br />Transportation Director Uche Udemezue noted at the community meeting the comments <br />received by the public were positive for both Alternatives 1 and 4. Mr. Udemezue <br />pointed out that there are Measure B funds sufficient to fund Alternative 1, and <br />Alternative 4 can be in1plemented as funds become available. Vice Mayor Glaze <br />inquired as to how the church traffic will be addressed. Mr. U den1ezue stated staff and <br />the church are working on ways to alleviate the problem. Vice Mayor Glaze recalled <br />the Council may have requested some follow-up on traffic and parking issues when the <br />matter of the church was considered previously. <br /> <br />M/S/C Glaze and Nardine. Matter of Update Regarding Use of Motorized Scooters in San Leandro (provides the <br />City Council with information concerning legislation regulating operation of motorized <br />scooters). (1004) <br /> <br />City Manager J ermanis gave a brief overview of the item and introduced Police Chief <br />Joe Kitchen. Chief Kitchen reported on the current laws governing motorized scooters. <br /> <br />City Attorney Williams stated the California Vehicle Code limits the ability of the City <br />to regulate motorized scooters. Ms. Williams stated her opinion that as a charter city, <br />San Leandro could enact local legislation promoting public health and safety, provided <br />the proper findings could be made. She described the types of local regulations adopted <br />by other municipalities. Chief Kitchen stated he has reiterated to the Patrol Division the <br />need for heightened enforcement of motorized scooters. <br /> <br />Vice Mayor Glaze inquired about the information needed to make the findings. Ms. <br />Williams replied that the information could be evidence or testimony which illustrates <br />the operation of nlotorized scooters in a particular area presents a safety hazard. Chief <br />Kitchen suggested the findings may be similar to those presented a few years ago on the <br />issue of skateboards in the downtown area, library and parking structure. Chief Kitchen <br />stated the Police Department would like to have the ability to impound motorized <br />scooters with modified exhausts or from operators under age 16. <br /> <br />Councilmelnber N ardine expressed concern regarding motorized scooters traveling <br />through uncontrolled intersections. Chief Kitchen noted that in uncontrolled <br />intersections, the operators of motorized scooters are required to yield to vehicles on <br />their right as do other motor vehicles. <br /> <br />Councihnember Santos suggested retailers that sell motorized scooters should be <br />required to post the laws governing use of the scooters, particularly the requirements <br />that the operator be at least 16 years of age and wear a helmet.
