1 (i) Controller 2 The Commission shall designate a Controller, which person shall be of the 3 same public agency as the Treasure. The Controller shall draw warrants to pay 4 demands against the Authority when the demands have been duly authorized by the 5 Commission and approved by the Manager. The Commission may designate the same 6 person to serve as Treasurer and Controller. There shall be strict accountability of all 7 Authority funds and report of all receipts and disbursements and compliance with Article 8 1, Chapter 5, Division 7, Title 1 of the California Government Code (Sections 6500 et 9 seq). The Controller shall either make or arrange for a contract with a certified public 10 accountant or public accountant to make an annual audit of the accounts and records of 11 the Authority. In each case the minimum requirements of the audit shall be those 12 prescribed by the State Controller for special districts under Section 26909 of the 13 California Government Code and shall conform to generally accepted auditing 14 standards. The records and accounts of the Authority shall be audited annually, and a 15 report thereof shall be filed as a public record with the Commission, each Agency, and 16 the Alameda County Auditor not later than six months following the end of the Fiscal 17 Year under examination unless said filing date is extended by the Commission. Any 18 costs of the audit, including contracts with or employment of a certified public 19 accountant, shall be borne by the Authority. 20 21 U) Access to Property The Treasurer and Manager are hereby designated as the persons who have 22 23 charge of, handle, and have access to the property of the Authority. Each such person 24 shall file with the Authority an official bond in an amount to be fixed by the Commission. 25 Cost of said bond shall be paid by the Authority. 26 (k) Officers, Emplovees and AQents 27 Any officer, employee, or agent of the Authority may also be an officer, 28 employee, or agent of any Agency. The appointment or employment by the Commission 29 of such a person shall constitute a determination that the two positions are compatible. 30 All privileges and immunities from liability, all exemptions from laws, ordinances 31 and rules, and all pension, relief, disability, worker's compensation, and other benefits 32 which apply to the activities of officers, agents, or employees of an Agency when -12-
