<br />when the Davis/Doolittle intersection mitigation measures are employed, a <br />significant relief of traffic congestion will be realized (LOS F to LOS D in 2025) <br />reducing delay by almost 50%. Similar improvements can also be realized with <br />the project in year 2006 with over a 40% reduction in delay from delay levels <br />without mitigation. Therefore1 the Subdivider/Developer proposes a more <br />immediate solution to relieve traffic congestion in the area as follows: <br /> <br />a. The Subdivider shall advance the total costs of improvements <br />(including right-of-way acquisition, design and construction) <br />required at the intersection of Davis Street and Doolittle Drive <br />(Options I & 2 combined) identified subsequent to the Traffic Study. <br />The extent of these improvements and alternative must be approved <br />by the Engineering and Transportation Department and Caltrans. The <br />preliminary construction cost estimate for required improvements <br />(Option 1&2 combined) for Davis Street and Doolittle Drive <br />intersection prepared by Engineering and Transportation Department <br />dated July 301 2002 is approximately $872,000. The improvements <br />in Option 1& 2 shall include but are not limited to additions of Davis <br />Street eastbound right turn lane, Davis Street westbound right turn <br />lane, and Doolittle Drive northbound right turn lane; median <br />modifications; new striping; demolitions of existing improvements; <br />right of way acquisition; and a new. 8-phase traffic signal. .15% of the <br />improvement costs shall be the ultimate responsibility of the <br />Subdivider and shall not be reimbursable. The remaining 85% of <br />total improvement costs shall be reimbursed to the Subdivider <br />through the establishment of traffic impact fees for the area. The <br />details and mechanism for these traffic impact fees shall be <br />determined by staff and presented to the City Council at a date <br />subsequent to the approval of the Subdivision, for consideration and <br />approval. Traffic impact fees collected by the City shall be forwarded <br />to the Subdivider as credit for the Developer's 85% reimbursable <br />contribution. At the end of five years, after Council's initial <br />acceptance of the subdivision, City agrees to reimburse the <br />Subdivider the difference between 85% of the total improvement <br />costs and all collected traffic impact fees for the intersection <br />improvements. This reimbursement shall represent improvement <br />costs which are not attributable to the Subdivider's development. <br />Subdivider shall work with staff to assiduously pursue all possible <br />legal means to assure the most timely completion of the Intersection <br />Improvement Project. The design for such improvements shall be <br />completed and approved by the City and Caltrans prior to the <br />issuance of the first certificate of occupancy for the development. <br /> <br />b.
