<br />Council, develop a Signal Timing Plan for the signals on Davis <br />Street between 1-880 Northbound Ramp to Doolittle Drive, to be <br />reviewed and approved by the City and Caltrans. The costs for the <br />preparation and implementation of the Signal Timing Plan shall be <br />fully borne by the Subdivider. Implementation of the Signal Timing <br />Plan shall be completed prior to issuance of the first certificate of <br />occupancy for the development. <br /> <br />c. The Traffic Study indicates that four (4) percent of the project's <br />traffic would use the proposed connection of Eden road between <br />Davis and Doolittle (Eden Road Project). Therefore, Subdivider <br />shall pay four (4) percent (fair share) contribution for the estimated <br />construction costs of acquisition of property and construction of <br />Eden Road between Doolittle Drive and Davis Street. The <br />preliminary construction cost estimated for Eden Road prepared by <br />Engineering and Transportation Department dated February 4, 2002 <br />is approximately $5.0 million. The project cost estimate shall be <br />adjusted based on Engineering News Record (ENR), Construction <br />Cost Index considering First Quarter 2002, as base year with index <br />value of 6501.69 published in ENR. The pro-rata share of costs for <br />each lot based on square footage (considering 8 lots total) shall be <br />assessed at such time as the City has established the funding of the <br />balance of the Eden Road Project cost through an assessment district <br />or other such public improvement financing vehicle. Each of the 8 <br />lots will contain an affirmative covenant agreeing to the <br />establishment of such an assessment district or other such financing <br />vehicle if established. <br /> <br />d. The Traffic Study recommending addition of westbound left turn <br />lane to provide access to the site. This will require striping <br />modifications or other improvements necessary on Davis Street to <br />accommodate addition of the left turn lane. All of these <br />improvements shall be constructed or must be included in the <br />Subdivision hnprovements Agreement prior to the Final Map. <br /> <br />e. Developer shall contribute to LINKS program (shuttle bus) <br />administered by the San Leandro Transit Management Organization. <br />The contribution amount, year when annual payment commences, <br />and terms of payment shall be determined by mutual agreement <br />between the developer and the City of San Leandro prior to approval <br />of the Final Map. <br /> <br />Revised Recommended Conditions of Approval <br />PLN2002-00031 Bayside Business Park <br /> <br />November 4, 2002 <br />Page 18 <br />
