<br />" <br /> <br />I. Project Site <br /> <br />a. The site subject to this Agreement is the field and play area <br />of the District property located at 1150 Bancroft Avenue, San Leandro, <br />California (APN 077-470-001-3) commonly known as Bancroft Middle <br />School (the "Site"), more specifically described in Exhibit A attached <br />hereto and incorporated herein by this reference. <br /> <br />b. The Site consists of 4.9 acres. <br /> <br />II. Design and Construction <br /> <br />a. City shall cause to be developed, designed, and constructed, <br />with approval by the District, a recreation open space improvement (the <br />"School Open Space Improvement"). The School Open Space <br />Improvement shall be consistent with the concept plan Option D, <br />attached hereto as Exhibit B and incorporated by this reference, and may <br />be modified by mutual agreement of the Parties and shall be consistent <br />with the requirement and within the funding limitations of the Grant. <br /> <br />b. City shall be responsible for selecting, hiring, and paYing all <br />professional service consultants and contractors required to complete the <br />construction project. District shall reimburse City for these costs as <br />outlined in Section III of this Agreement, District shall have the right to <br />approve all professional service consultants prior to their being hired. <br />Such approval shall not be unreasonably withheld. <br /> <br />c. In constructing the School Open Space Improvement, the <br />City shall conduct all required environmental testing (if any), obtain all <br />necessary permits, and shall comply with all applicable state laws. <br />District will assist with coordination and processing of approvals with the <br />California Department of the State Architect (if needed). If City discovers <br />any hazardous condition(s), the City may choose not to proceed with the <br />project and shall notify the District to that effect. <br /> <br />d. City shall have the right to enter into agreements for the <br />required architectural and engineering services and bid, award, and <br />administer construction contracts utilizing City standard contracting <br />methods and procedures and applicable laws governing City government. <br />City will document the project in a manner consistent with the City'sostandard practices and the requirements of the Grant. <br /> <br />e. Prior to the start of design of the School Open Space <br />Improvement, District shall provide record drawings of the site, <br />
