<br />benefits under this Chapter as to such employee. Premiums charged the employee for benefits <br />may not be credited towards the minimum compensation requirement. If the P AB contributes <br />towards health benefits on some basis other than hourly payments, and the P AB wishes such <br />contributions credited, then the P AB shall provide the City Manager with sufficient data to <br />estimate the hourly value of such health benefit contributions. For example, if the P AB produces <br />data showing it spends $450 per month per employee, the City Manager will divide that sum by <br />the number of hours worked by full-time workers in an ordinary month (173.3) and thus estimate <br />the hourly value of such benefit contributions as $2.60 per hour. In order to obtain the benefit <br />credit the P AB shall have the option of paying for employee medical expenses out of its general <br />assets rather than through a segregated fund or plan. <br /> <br />1-15-310 <br /> <br />Cost of Living Adjustments <br /> <br />Beginning one year after the effective date of this Chapter, the minimum cash wage <br />above and the health benefit credit above shall both be upwardly adjusted annually, no later than <br />April 1 st, in proportion to the increase as of the preceding December 31 st over the prior year in <br />the Bay Region's Consumer Price Index as published by the U.S. Bureau of Labor Statistics and <br />health expenditure portion of such index. The City shall publish a bulletin by March 1 st of each <br />year announcing the adjusted rates, which shall take effect 30 days from such publication. Such <br />bulletin will be distributed to all P ABs covered by this and to any other person who has filed <br />with the City a request to receive such notice. A P AB shall provide written notification of the <br />rate adjustments to each of its Employees and to its covered tenants, contractors and . <br />subcontractors, who shall provide written notices to each of their Employees and make the <br />necessary payroll adjustments by July 1 following the City's notice of the adjustment. <br /> <br />1-15-315 <br /> <br />Prevailing Wage for Janitorial Employees <br /> <br />If the prevailing wage for janitors posted by the State Department of Industrial Relations <br />(or any successor agency) exceeds the compensation required by the foregoing provisions, then <br />the P AB shall pay its janitors the posted prevailing wage. <br /> <br />ARTICLE 4. <br /> <br />OTHER MINIMUM STANDARDS <br /> <br />1-15-400 <br /> <br />Notification of Earned Income Credit <br /> <br />Each PAB shall inform each Employee who makes less than twelve dollars ($12.00) per <br />hour in wages of his or her possible right to the federal Earned Income Credit (IBlC") under <br />Section 2 of the Internal Revenue Code of 1954,26 U.S.C. ~32, and shall make available the <br />forms required to secure advance EIC payments from the business. These forms shall be <br />provided to the eligible Employees in English (and other languages spoken by a significant <br />number of such Employees) within thirty (30) days of employment under this Chapter and as <br />required by the Internal Revenue Code. <br /> <br />3 <br />
