<br />3. That the proposed use will comply with the provisions of this code; including any <br />specific condition required for the proposed use, in the district, in which it would be <br />located. <br /> <br />The CC(PD) and IL(PD) designations also allows for a Planned Development (PD) <br />application. A specific condition is that a PD application is discretionary in the CC (PD) and <br />IL(PD) District and that the reviewing bodies will determine if the proposed use is <br />compatible with the existing and proposed uses in the general vicinity. Furthermore, the <br />purpose of the PD overlay district is to provide a process for the development of large <br />parcels of land to reduce the rigidity of zoning standards and to provide a mechanism for <br />considering uses that can be compatible by application of careful and imaginative treatment. <br />In this instance, the planned development process would allow select IL District uses in the <br />CC zoned portion of the site and the FAR (Floor to Area Ratio) being slightly greater by <br />0.06, of the 0.50 maximum permitted in the CC District. The PD review process will enable <br />the City to impose the necessary conditions of approval to protect the character of the <br />surrounding area. <br /> <br />4. That the proposed use will not create adverse impacts on traffic or create demands <br />exceeding the capacity of public services and facilities, which cannot be mitigated. <br /> <br />The existing subject property is adequately served by streets, utilities and other public facilities <br />without detriment to the immediate area. The proposed self-storage facility and associated <br />parking lot and landscaping will not significantly affect the public utilities and facilities already <br />serving the existing immediate area. <br /> <br />5. The Planned Development Project Plan will provide superior urban design in <br />comparison with the development under the base district zoning regulations. <br /> <br />The site planning for the commercial/light industrial building and the self-storage facility <br />allows for adequate building setbacks, landscaped setbacks, vehicular circulation and parking. <br />The design of the project contains site improvements that contribute to the character of the <br />Planned Development, including architectural design which includes the use of various exterior <br />materials, [mishes and colors, and articulated elevations for the building. The overall design <br />and features included within the Planned Development enhances the appearance of the site, <br />specifically the Washington Avenue street frontage. <br /> <br />6. The Planned Development Project includes adequate provisions for utilities, services, <br />and emergency vehicle access;' and that public service demands will not exceed the <br />capacity of the existing and planned systems. <br /> <br />There is adequate public service provided to the proposed subdivision, including but not <br />limited to the gas and electric, the water, waste disposal, cable television, and police and fire <br />services. The Engineering and Transportation Department and Alameda County Fire <br />Department have found the access to the site and internal circulation to be safe for vehicular, <br />pedestrian and emergency vehicle access. <br /> <br />Recommended Findings of Fact <br />PLN2007 -00027 <br /> <br />June 14, 2007 <br />Page 2 of2 <br />
