<br />3. To minimize potential business environmental risk prior to purchasing the property, the <br />potential for environmental contamination along the sump discharge pipe should be <br />evaluated by determining the layout of the pipe and collecting/analyzing soil samples <br />along the pipe. <br /> <br />H. Prior to issuance of grading permits, the applicant shall be required to obtain from the <br />R WQCB either <br /> <br />1. A site closure letter related to the UFST, or <br /> <br />2. Submit a remediation plan, to be reviewed and approved by the RWQCB and the City's <br />Environmental Services Manager. <br /> <br />1. Prior to issuance of building permits the following studies shall be conducted and <br />completed to the satisfaction of the City's Community Development Department: <br /> <br />1. Prior to issuance of building permits, the construction documents for the residential <br />components of the development shall include details and specifications to achieve <br />compliance with the City criteria for control of exterior noise which are based upon <br />limiting the interior CNEL to 45. The details and specifications shall include the proper <br />wall construction, window glazing and weather-stripping, exterior doors that are solid- <br />core, well fitted and weather-stripped. In addition, keeping the windows closed would <br />necessitate the installation of mechanical systems to ensure adequate ventilation is <br />provided. <br /> <br />2. The following measures are expected to achieve compliance with the City criteria for <br />control of exterior noise which are based upon limiting the interior CNEL to 45. The <br />primary noise control measures that must be implemented are that the units be provided <br />with artificial ventilation so the windows may be kept closed at night, and that the <br />windows be adequately glazed and weather-stripped. Non-rated windows that comply <br />with Title 24 thermal and air infiltration standards will normally be glazed and <br />weather-stripped in a manner which will provide an adequate barrier to exterior noise <br />of this magnitude when closed. The artificial ventilation requirement is met by <br />providing the capability of the forced-air furnace to operate without heating. At a <br />minimum the exterior doors shall be solid-core, well fitted and weather-stripped. <br /> <br />J. Prior to Final Map approval, the applicant shall submit park in-lieu fees, to be determined <br />by the City Engineer, to off-set the deficiency of on-site park acreage. <br /> <br />K Prior to approval of the Final Map, the applicant shall provide an analysis prepared by a <br />registered Civil Engineer to determine water and wastewater needs for the project site, to be <br />reviewed and approved by the City Engineer. All improvements needed as a result of these <br />analyses shall be implemented as part of the overall on- and off-site improvements, or if these <br />improvements are completed by others, the applicant shall pay its fair share of costs to the <br />City, to be reimbursed to the appropriate entity that completed the improvements. <br /> <br />L. In the event that archaeological resources, prehistoric or historic artifacts are discovered <br />during any construction or excavation, the following procedures shall be followed: <br />Construction and/or excavation activities shall cease immediately and the Development <br />Agreement to Conditions February 2, 2004 <br />PLN2003-00046 Page 11 of 12 <br />
