D. Since the project is proposed as condominium the CC&R's will need to include <br />the maintenance and no parking on any fire access roads provided in the complex. <br />V. CONSTRUCTION PROVISIONS <br />A. Construction activity on private property shall not commence prior to 8:00 a.m. <br />and shall cease by 5:00 p.m. Monday through Friday, and no construction activity <br />is permitted on Saturday and Sunday. No such construction is permitted on <br />Federal holidays. As provided in this City of San Leandro's Noise Ordinance <br />(ORDINANCE NO. 2003 - 005), "construction" shall mean any site preparation, <br />assembly, erection, substantial repair, alteration, demolition or similar action, for <br />or on any private property, public or private right-of--way, streets, structures, <br />utilities, facilities, or other similar property. Construction activities carried on in <br />violation of this Article may be enforced as provided in Section 4-11-1130, and <br />may also be enforced by issuance of a stop work order and/or revocation of any or <br />all permits issued for such construction activity. <br />B. Construction activity shall not create dust, noise, or safety hazards for adjacent <br />properties. Dirt and mud shall not be tracked onto Neptune Drive from the project <br />site. <br />C. Prior to approval of the Final Map, detailed plans for the building permit shall be <br />submitted to the Chief Building Official for review and approval. Said plans shall <br />include details and specifications on the following: <br />1. The required separation of utilities (i.e., electrical, plumbing, et cetera.). <br />2. The required physical separation of the two units within the two-family <br />dwelling. <br />3. The required fire wall and sound separation between the two units within the <br />two-family dwelling. <br />VI. FENCING AND SCREENING REQUIREIVIENTS <br />A. The plans submitted for building permits shall show the location, details and <br />specifications of all the new fencing along the perimeter property lines, all new <br />fencing separating private outdoor areas, and any other proposed fencing on the <br />property. Fencing along the interior side property lines and rear property line, not <br />located within the front yard setback shall be permitted to be constructed to a <br />maximum height of six feet pursuant to the RO Residential Outer District. <br />Moreover, any fencing within the front yard setback shall not exceed three feet in <br />height per the RO District requirements. <br />B.
