legally barred from later challenging any such fees, dedications, reservations or <br />other exactions. <br />C. Design review fees, development impact fees, permit fees, inspection fees, and <br />any other fees charged by the City or other reviewing agencies for the review, <br />approval, permitting and inspection of the above listed public improvements shall <br />be paid by the Applicant. <br />D. Prior to the approval of the building permit, the applicant shall pay the <br />underground utility conversion fees for the East 14th Street frontage in accordance <br />with the provisions of the City Underground Utilities District Master Plan. <br />(Approx. $182/LF -Actual amount will be calculated at time of Building Permit <br />application) <br />E. The Applicant shall pay Park Development Impact fee prior to the issuance of any <br />Building Permits for the residential units. The fee shall be paid considering the <br />project asMulti-Family units as per Master fee schedule ($11,383/unit). <br />F. Prior to the issuance of any Building Permits for the site, the Applicant shall pay <br />Development Fee for Street Improvements (DFSI) (Credit will be given for the <br />existing use), Sewer Connection fee and other fees as required by City Ordinances <br />and regulations. The exact fees will be determined at the time of Building Permit <br />Issuance and may be adjusted to reflect any change in the ENR Construction Cost <br />Index. <br />G. Prior to the issuance of building permits for the project, the Applicant shall obtain <br />an Encroachment Permit from the Engineering and Transportation Department for <br />any work within the public right-of--way. <br />H. If the design of any site improvement requires encroachments onto neighboring <br />properties during construction, written agreements with that property owner shall be <br />submitted to the City Engineer, for review and approval, prior to issuance of <br />encroachment permits. <br />I. Prior to issuance of a building permit, the City Senior Traffic Engineer must <br />approve all drive widths and sections within the project site. The driveway to the <br />gated parking area shall be a minimum of 18 feet in width. Parking space shall <br />meet City standards including parking space widths and aisle widths. <br />J. Prior to issuance of a building permit, a detailed parking lot signage and striping <br />plan shall be submitted for the review and approval of the City Senior Traffic <br />Engineer. Said plans shall also include detailed specification for a warning light at <br />the entry of the enclosed parking garage area. <br />K. Applicant shall remove unused driveways, any substandard or damaged curb, <br />gutter and sidewalk, along the full project frontage on East 14th Street and shall <br />Agreement to Conditions June 1, 2006 <br />PLN2006-00040 Page 5 of 9 <br />
