Zoning Code Amendments 6 January 7, 2008 <br />Fences, Walls & Hedges, On-Line Auto Sales and TOD Follow-up Items <br />Environmental Review <br />The proposed ordinances for the adoption of Zoning Code amendments related to various use <br />regulations and development standards changing the Fences, Walls and Hedges standards, <br />allowing limited on-line auto sales and changes prompted by the Transit-Oriented Development <br />(TOD) Strategy are exempt from environmental review under the California Environmental <br />Quality Act pursuant to Section 15061 (b) (3). This is because the proposed ordinances have no <br />potential for causing a significant effect on the environment. These ordinances do not, in <br />themselves, allow the construction of any projects and therefore, have no potential for resulting <br />in physical changes in the environment, directly or ultimately. <br />Code Compliance Review <br />Not applicable. <br />Board/Commission Findings <br />At the joint Planning Commission /Board of Zoning Adjustments worksession, the consensus for <br />direction to staff was to analyze the option of allowing additional transparent fence materials, such <br />as welded wire and ornamental iron and to discourage the use of plexi-glass and plastic materials, <br />due to their propensity to lose transparency over time. <br />The Planning Commission reviewed the matter at its December 13, 2007 meeting, recommending a <br />motion to the City Council to limit the transparent fence materials to glass, with any other <br />transparent materials subject to review through a fence modification process before the Zoning <br />Enforcement Official. <br />Minutes from the joint Planning Commission /Board of Zoning Adjustments worksession and <br />Planning Commission hearing are enclosed. <br />Summary of Public Outreach Efforts <br />Legal requirements for notification of this meeting included publication of a legal notice in the <br />Daily Review and posting of the meeting agenda at City Hall a minimum of 72 hours in advance <br />of the meeting date. Notices were also mailed to a total of four interested property owners, the <br />San Leandro Chamber of Commerce and to the City's list of Homeowners Associations. On <br />November 8, 2007, a joint worksession was held between the Planning Commission and the <br />Board of Zoning Adjustments in the Sister Cities Gallery, which was also noticed according to <br />the above protocol. On December 13, 2007, the Planning Commission met in the South Offices, <br />which was also noticed according to the above protocol. <br />Fiscal Impact <br />Not applicable. <br />Budget Authority <br />Not applicable. <br />
