Transit-Oriented Development (TOD) Strategy Follow-Up Items <br />Article 2, Section 1-204, Base Zoning Districts <br />Article 6, Section 2-636, Use Regulations <br />Article 16, Section 4-1662, Outdoor Facilities and Storage /Loading Facilities <br />Article 16, Section 4-1666, Refuse Storage Areas <br />Article 16, Section 4-1672, Earth Station and Microwave Equipment <br />Article 16, Section 4-1674, Bed and Breakfast Inns <br />Article 18, Section 4-1806, Regulations for On-Premise Signs <br />A legal ad was placed in the Daily Review and notices were sent to interested parties to inform <br />them of the proposed Zoning Code changes. <br />Staff recommends that the Planning Commission and Board of Zoning Adjustments hear the staff <br />presentation, discuss the material and provide staff with direction on proposed changes for the <br />December 13, 2007 Planning Commission meeting. The Planning Commission will hold a <br />public hearing on this matter on December 13, 2007 and the City Council is scheduled to hear <br />this matter at their January 7, 2008 meeting. <br />DISCUSSION <br />The proposed draft ordinances relating to clean-up items associated with the Transit-Oriented <br />Development (TOD) Strategy; Fences, Walls and Hedges in the RS-VP Zone; and Limited On-Line <br />Used Vehicle Sales maybe summarized as follows: <br />Fences, Walls & Hedges in the RS-VP Zone <br />Section 4-1682 of the Zoning Code relating to Fences, Walls and Hedges is proposed for <br />amendment to provide additional restrictions on fence heights and to preserve views in the RS-VP <br />District. As such, the primary changes proposed for this section of the zoning code are to provide <br />additional guidelines for fence and wall materials. Fence heights in the RS-VP District have been <br />limited to 7 feet except in required front, side or corner side yards where the maximum height shall <br />be three feet above natural grade. Further, the top portion of any new fences in the RS-VP zone <br />shall be require to be transparent to allow for continued enjoyment of views and to promote an open <br />feeling. <br />Limited On-Line Used Vehicle Sales <br />To accomplish the intent of these changes to the Zoning Code that allow for limited on-online <br />used vehicle sales, various Sections of the code were amended. Currently, a conditional use <br />permit is required for online vehicle sales. However, the Planning Department has determined <br />that limited on-line vehicles sales should be allowed in certain Commercial and Industrial zoning <br />districts, provided specific requirements are met to ensure that these sales do not adversely <br />impact surrounding land uses.
