II. PERMITTED USES <br />A. This use permit approval is for the conversion of the Woodside Apartments, a 96- <br />unit apartment complex, to condominium ownership. As part of the condominium <br />conversion approval, the property owner shall increase the current off-street <br />parking supply and increase the amount of laundry facilities. The total number of <br />parking spaces shall be a minimum of 180 spaces on the property. The guest <br />parking spaces shall be marked or signed for guests use. The total number of <br />laundry facilities shall be a minimum of 20 washers and 20 dryers. This is also the <br />approval of a modification to the Planned Development (PD-85-2) to reduce the <br />amount of landscaped setback along the Haas Avenue frontage and to improve the <br />frontage of the property with new architectural and decorative structures <br />combined with a new landscape (planting) composition. This is also approval of <br />Vesting Tentative Map Tract No. 7767 to create a subdivision for condominium <br />ownership of 235 Haas Avenue, also known as Alameda County Assessor's Parcel <br />Number 76-437-7-1. <br />B. This use permit approval for the conversion of the Woodside Apartments also <br />provides that certain trees specified by the arborist in the tree report shall be <br />removed, specifically three redwood trees along the front of Building A. <br />C. The applicant shall comply with Zoning Code Article 24 Residential <br />Condominium Conversions including but not limited to providing benefits <br />(concessions) to the tenants such as: <br />1. No rent increases. The tenant's rents will not be increased within two months <br />prior to the project application, nor would the rent be increased for two years <br />from the time of the filing of the project application or until relocation takes <br />place. <br />2. Lifetime leases. The applicant has offered lifetime leases to tenants who are 62 <br />years of age or older and those who are handicapped for the units they occupy <br />on the date of the notification of intent to convert. This offer shall be <br />considered a condition of approval. <br />3. Moving Allowance. The applicant shall provide a moving allowance equal to <br />three times the monthly rent only to tenants that were living at Woodside <br />Apartments on March 2, 2006 and received the initial "Notice of Intent to <br />Convert," and are still living at Woodside at the time they receive a notice to <br />vacate. Tenants moving on to the property subsequent to the initial notice are <br />not eligible to the specified moving allowance. <br />4. Discounts on the price of the units. The applicant has offered a discount for up <br />to $4,000 of the market rate units if the tenant decides to purchase his or her <br />respective unit. <br />Recommended Conditions of Approval (Revised) December 13, 2007 <br />PLN2006-00059 Page 2 of 14 <br />
